Superintendent of Public Instruction June Atkinson got her day in court. She is North Carolina’s elected, but largely powerless education leader and she is trying to force Governor Perdue to put her back in charge of running the state’s education policy. Atkinson sued Perdue and the State Board of Education in April. She contends that North Carolina voters elected her to the superintendent’s post and Perdue’s decision to name a chief executive officer for the public schools was illegal. She asked the courts to declare the scope of the state superintendent’s constitutional powers.
