NC court denies husband’s request for trial delay

RALEIGH, NC (AP) — The North Carolina Court of Appeals has turned down a request by a man charged with killing his wife to delay the start of his trial.

The court on Thursday dismissed a request by lawyers for 37-year-old Brad Cooper to postpone the trial, which is scheduled Feb. 28.

The appeals court has not yet decided on a second request by Cooper’s attorneys regarding access to evidence. The court is waiting until prosecutors respond.

Cooper is charged with murder in the death of his wife, Nancy. Her body was found near a storm drain in an unfinished Cary subdivision less than three miles from the couple’s home in July 2008.

Earlier this month, Brad Cooper pleaded not guilty.
