WILMINGTON, NC (WWAY) — One year after filing a nearly $500,000 lawsuit against a Wilmington restaurant owner, RBC Bank is still waiting for a decision.

The bank says when Two Guys Grille took over Bear Rock Café at Independence Mall in 2007, it also took over a promissory note between Bear Rock and RBC. The complaint in state business court claims Two Guys owner Jonathan Duea committed fraud by denying he owed the debt, then dissolving the company and forming a new one to avoid paying it.

Duea filed for bankruptcy last month.

Mediation in the case is scheduled for this fall.
