Trooper gets four-day suspension

RALEIGH, NC (WTVD) — The North Carolina Highway Patrol said Wednesday that one of two troopers involved in an incident with the wife of a Raleigh attorney has been given a four-day suspension without pay as punishment.

Trooper Andrew Smith will begin serving the suspension immediately.

The suspension comes after an internal investigation concluded Smith’s behavior was unprofessional and violated the Highway Patrol’s conduct policy.

The investigation came after the Highway Patrol received a letter of complaint from Hoyt Tessener, a Raleigh lawyer, alleging misconduct by Trooper Edward Wyrick during a traffic stop of his wife, Gina Tessener.

The Tesseners said Wyrick was bullying and overly aggressive.

During their investigation, the Highway Patrol released text messages exchanged between Trooper Smith and Trooper Wyrick in reference to pulling over Gina Tessener.

The Tesseners, who are from Raleigh, were in Wilmington on June 22 attending an event. Hoyt was following his wife in a separate car when she was pulled over by Wyrick.

Trooper Wyrick says he stopped Gina for a broken headlight, however, smelled alcohol on her and asked her to complete a field sobriety test, but she refused.

“This woman refused all roadside testing, and blew .00,” Wyrick wrote in a text to Smith. “Her husband is a trial lawyer and told me I should be ashamed of myself.”

Smith responded: “Hahahaha f— her and f— him. She say how much she’d had to drink?”

“She said 1 drink at 7pm,” Wyrick wrote back.

“F— her,” Smith responded.

After reviewing the case, the Highway Patrol said Trooper Wyrick was justified in pulling over Gina Tessener and had probable cause for a DWI arrest.

    …that you have full control of your faculties by any sense of the imagination. It only proves you were able to progress through a series of tests and is only the most basic indicator of intelligence. The are far too many lawyers, doctors and engineers that would be much better off as plumbers and trash collectors!

    We have a society of “production education” where they flush students through college like a Chinese toy factory production line with the only Quality Control being a test paper where no “inherent talent” requirements exist. Most would fail basic geography, history and certainly english questions. Leno has proven this many times!

    Just take a look at our leaders…Edwards, Clinton, Blagoeabitch, etc. There is an endless list of perfectly ignorant, highy educated individuals. Why would we expect any different from a couple of buzz-headed, big shot NCSHP troopers on a power trip?


    I can promise one thing if either of these troopers stop me I will call 911 to have a witness. Trooper Smith made it clear they are in competition to see who can get the most tickets or arrest. Well they are certainly pushing the letter of the law with intimidation and with nothing really happening to either one that just tells them go harass the public. It’s very sad that our Govenor has no balls to stand up for the public and say enough is enough! These troopers should be fired immediately. They really give the good officers an BAD name and it makes the public not trust the police. The way to respect is you give it you get it back! Clearly these officers have NO RESPECT for the public!

    It is puzzling to me that educated people have to use profanity. Many times I have asked users of profanity how much education they have. I don’t try to make them feel foolish. They do that to themselves. I do wonder why so many people in public life feel that they have to use vulgarity.

    SHP troopers, and all public servants, should set an example for us citizens. I can’t understand why it is necessary to use the “F” word. Anyone who has completed grade school has a decent enough vocabulary to eliminate the four-letter words. When I hear this type talk, it tells me a lot about the public official, or anyone else for that matter.

    I hope that this trooper, and other officers, realize that they are held to that higher standard. Set me an example, Sir!

    Pretty sad that a man gets 4 days off for sending a text on his personal phone.

    Sure he didn’t fill out the traffic stop report, but I bet he wasn’t the first and I bet the rest weren’t suspended for forgetting to do one.

    Oh, and since the SHP said he should have cited Tessener, when are they going to give him his citation for 13mph over the limit?

    And is the Governor going to give an interview where she says she has a 0% tolerence for blowhard lawyers wasting tax payers’ money?

    If you read the whole story previously you would know the two troopers made these comments via the state supplied network and laptops they had in their cars so no he wasnt suspended for texts on his personal phone it was on their instant messaging service on the state/tax payer paid hardware and network so now you can go back into your hole little troll and quit defending this powerhungry jackbooted moron. I still cant believe Wynrick is getting off because its quite obvious he set up the traffic stop with Smith and such. Wynrick obviously lied in his reports obviously he had to come up with some lie about her saying she ha da drink to justify his stop and harassment of her otherwise it wouldnt have even met probable cause. She told people she hadnt been drinking and its probably the truth considering she did blow .00 twice, but any good little corrupt thug is going to make the paperwork match in order to CYA themselves. Tpr Wynrick needs to be very careful because I can guarantee if hes done this, hes probably done it before and he’ll make the same mistake again. Wannabe power trippers dont change their ways and as they saying goes tell me who your friends are and Ill tell you who you are and it seems pretty obvious Smith and Wynrick are good ole boys with each other.

    The fact is he used profanity on text against a citizen & orchestrated a conspiracy between himself and his co-worker misusing his badge against tax paying citizens to sexually harass a lone blond female driver at night. The only reason we heard about it is because it was a lawyer’s wife. These situations go unreported many times. He should have been fired.

    i got pulled one night by a city cop and he said he smelled alcohol in my new car that had never had alcohol in it. so he obviously didn`t believe me when i told him i hadn`t been drinking. he got me out and had me blow into the tester and sure enough 0.0 . of course he came up with charges for me (bogus of course). he wrote me a ticket and sent me on my way. i`m a 6`1″ 220lb guy. and didn`t have on a pretty dress.

    cops have to be on a serious power trip to even want that job.
    they are not the heroes they portrayed to be.

    Smith should have arrested Hoyt for speeding. He would have resisted, which would have led to him being tazed, sprayed, etc. Trooper Smith, quit giving out warnings and HTFU!

    Foul language is unbecoming to anyone who uses it under any circumstances. The officer should have his hands slapped. I respect our law enforcement officers, but they should act in a manner that deserves, and earns that respect. The trooper did not; he’s been punished, now this story can be put to bed.

    Hoyt Tessener is a proven cheapskate, and a liar. He punced a man over a bar tab, and didn’t get a headlight fixed, when it was reccomended, and $200.
    I believe he coached Troophy Wife. I believe he was just trying to set his wife up as a victim, for a payoff.
    He obviously has a hard time keeping depressed Trophy Wife in drinks.
    He’s just the opposite of the rich “Bigshot” he pretends to be.

    Based on previous news articles, the officers’ phones were not supplied by the state. They are “personal” phones. They didn’t have to divulge their texts, but did so to show they didn’t set anyone up. The only messages sent via government-owned network were after Mr. Tressenor was pulled over and let off without a citation.

    Yeah your right they will both screw up again and this time get caught for it. Smith suspended for 4 days and bet it’s with pay as usual, a mini vacation. Ever notice when these jokers are being suspended it’s always with pay? Read about a police capt a while back suspended for 6 months with pay and then fired, a 6 month paid vacation. Ever notice from Smith’s picture he looks like one of the guys from the movie Deliverance, kinda like the boy playing the banjo on the porch in it. Creepy looking.

    Actually the comment on the state computer was “if he gives you too much trouble send him back and I’ll stroke him for the speed” The other messages were on their personal cell phones according to the full investigative report.

    I think WWAY TV 3 owes Trooper Wyrick and family an apology for showing up at his house without all the facts, jepordizing not only him now but his family.
    You don’t see the news media beating down burgulary suspects doors asking them questions. Better yet ROMAN how about we show up at your house and ask you a few questions.

Their reputation has been in the crapper for a number of years and these clowns are just going to be in the long list of stories you can research and find on them (NCSHP). I have posted some in these threads and I notice all you supporters of the NCSHP have made no comment when the outcome was against them, nothing to say HUH. I understand no way to defend them.
