WILMINGTON, NC (WWAY) -- A man is dead after being hit by a truck on Carolina Beach Road.
According to the Wilmington Police Department, 40-year-old Robert Whitton of Wilmington was killed around 2:45 p.m. Saturday near the intersection of Shipyard Boulevard and Carolina Beach Road. He died on the scene.
After consultation with the District Attorney's office, it has been determined that no charges will be filed in this case.
Today's death was the third pedestrian fatality in Wilmington this year and the second pedestrian fatality on Carolina Beach Road, inside the city limits, in 2011.

The pedestrian tried to run across the road at an undesignated crossing and the driver of the car, who was weaving in and out of traffic couldn't see him until the last minute because other cars were blocking his vision.
Pedestrians should ALWAYS cross at a crosswalk or a traffic light. Jaywalking has claimed many lives.
