FIRST ON 3: Leland Town Council reveals Chief Jayne placed on probation in Sept., forced to pay restitution

LELAND, NC (WWAY) — During a meeting Thursday night, the Leland Town Council announced that Police Chief Tim Jayne has been on probation for months.

During the meeting, leaders revealed that on September 15 Jayne received a written reprimand and was ordered to pay restitution for use of a town-owned vehicle. He was also placed on six months probation “for management actions inconsistent with Town of Leland personnel policies and professional management standards,” according to our news partners at the Local News Review.

Jayne was also ordered to adhere to the personnel policy in the future and develop an action plan.

Town Council allowed Town Manager David Hollis to release the personnel matter citing North Carolina General Statute § 162A-6.1 (7), which allows the release of such information if it means maintaining public confidence in a public agency. It’s the same statute WWAY has been encouraging the town to use for months to answer questions about a number of issues within the police department.

Jayne was placed on probation the same day as a Town Council meeting during which the town agreed to a settlement with Ofc. Sherry Lewis, who was shot in the crotch several times during a training exercise last spring. After that meeting, then-Town Manager Bill Farris said he didn’t know that anyone had been shot and then-Mayor Walter Futch admitted he was “out of touch.”

In the weeks and months since, Leland town leaders have refused to talk publicly about significant questions regarding their police department. Allegations included Jayne using his town-owned vehicle for personal trips, including to a bachelor party in Myrtle Beach, where he reportedly punched one of his officers; reports of an officer pointing a gun at a fellow officer; reports of officers having sex at the police department on duty.

In October, Town Council directed Jayne to send a letter to the SBI requesting an investigation of any allegations of criminal activity within the police department and improper release of personnel information. Mayor Brenda Bozeman, who took office last month after having served on the Town Council, has repeatedly said she would wait for the results of that investigation before making any judgments.

Jayne has called media reports about the issues within his department a “witch hunt” and claimed former Assistant Town Manager Michelle Cox, who recommended Jayne be fired for misconduct, was personally trying to destroy him. There have also been reports that Jayne has forced officers to take lie detector tests as he tries to find the source of leaked information. Hollis told WWAY no one has been “forced” to take the tests. Meanwhile, several officers have been fired from the department in the last couple of months.

    They don’t follow their own policies anyway. The policy says that he should have received at least twelve months of probation and because it involved the use of a town vehicle his priviledges should have been taken away for twelve months too but of course since he is the General he is treated differently than everyone else that have done a lot less. Of course they will change the policies to suite their pruposes like they do all the time. It sounds like derliction of duty to me. We like all of law Enforcement through out North Carolina are Laughing our AZZES off. If you want an opinion about these clowns just mention the name of Leland anywhere within the Law Enforcement world. They will start laughing right away.
    Just look up the definition of Bad Cop and you’ll see all of the administration of Leland Police Department pictured there.

    Not forced to take test. Ask those who were there. Mr. Hollis you need to quit relying on the information you are being hand fed. …………Just wait and see. When the town finally unseals all of their information you will see.Of they will probably won’t for some time because they know the truth and they are scared.

    Kevin Wuzzardo and Scott Pickey deserve an Emmy for their work on this story. Is there anything higher than an emmy for local news reporting? If so, you guys deserve it.

Name calling, disparaging remarks concerning physical appearance, painfully bad rhymes and uncontrolled anger seem to be all you’ve got.     The original post was suspended. Wow “Probation”? Guessing the crooked council thought this would shut us up? And he is forced to pay back the $24.00 he used for gas!? Well that aught to teach him!!! The town from the floor up is a disgrace. I’m starting to wonder if they are going to get away with it. The corruption is just so deep. They even put up the G.S.# To prove the man broke the Law and got away with it. Its so blatantly obvious, it’s like they are mocking the citizens of Leland. Sorry folks its “Time to Rhyme”

    He’s only been put on probation which you and I both know tht means squatt! He has still been there firingg people of good character instead of “doing the right thing”. Hey when the criminals are put on probation do they still get to deal drugs or keep on doing crime? Well I guess Jain still does. He keeps on screwing up people’s lives and getting a paycheck for it. Hmmmm, thanks to the Town Council and Hollis for taking care of the problem. Not!

    Probation? Are you serious? Anyone else would have been out on their A**, FIRED, BYE-BYE. Any police chief with any sort of moral character would have resigned in the wake of the settlement with the harassed officer. He needs to go.

    Plenty of stuff has been ongoing since Sept 15th to include the hostile work environment and illegal termination of the officer he assaulted in Myrtle Beach in 2010. How is Jayne not been terminated or is this a case of they are going to ‘review’ his performance and either terminate him in March (once the 6 months is up) continue probation or remove the probation. This town cant take another 2 months of his leadership and the SBI and FBI are breathing down their necks

    Don’t you get it. The town released this now because they are laying the ground work for his termination. They gave him 6 months so he would either hang himself or the story would die. The story hasn’t died, nothing has improved. He needs to see the writing on the wall……………….you day is coming.

    So he gets to keep his job, while other good honest people who did nothing wrong lose theirs. Seems like he should have been gone and I bet the personnel policy wasn’t even followed at all, as it hasn’t been with all the illegal, wrongful terminations or promotions for that matter. Of course, what do you expect when there is no accountability, performance evaluations or leadership? What works in Leland is how much butt you kiss but, how much you will lie and how much you are willing to stand by, keep your mouth shut and watch people being taken advantage of.

    Those on council-especially Bozeman and Battleman have known all along what was being done and the illegal practices of not only the police chief but of the town administration. What we have here is the same BS. They kept it quiet because they wanted the power and they assumed it would go away because it always does. They simply offer hush money and because people are out there with no money and they have families to take care of they see no other way but to take it and hope for the best when they look for employment.

    They failed to count on the fact that there were some people with the fortitude to stand up and say no this is wrong and we are not going to take it. So, why release it now………… because they knew they were wrong and they wanted to get by as cheap as possible in any settlements. Now that they accomplished that with 2 officers they figured the citizens were dumb enough to accept this as the town handling the situation……………in other words………………a governmental whitewash.

    There are still more fights to come. You can’t run and you can’t hide. Might and right will prevail and the decisions that each of you have participated in will eventually be known.
