WILMINGTON, NC (WWAY)– It’s not illegal, but many say flying a flag above the American flag is disrespectful. Neighboring business owners say a used car dealership on Market Street has been flying its flag above our nation’s for months, and they want it to stop.

“It’s just offensive all the way around,” said Stephen Blanton, owner of Southwinds Hair Designs. “You shouldn’t do that. You never fly another flag above the American flag, it’s just totally disrespectful.”

For those people who work at Southwinds Hair Designs, they look out their window everyday and see what they say, is simply un-American.

“I resent it actually,” said Tammy Melvin. “I mean, I know people that have been in the military, and it doesn’t have to always be about the military, but they fought for us.”

They say the flag has been flying above the American flag at Munn Motorsports for months. Ownership of the dealership says it was a simple mistake.

“As you can see the last wind storm we had has ripped it apart and just flipped it over the other way,” said John Munn, owner of Munn Motorsports. “We were waiting on the new flag to come in to bring it down and switch it but it’s a good point so we’re just going to let the American flag fly by itself as it should and then I’m going to fly this once I get a new one in.”

Munn Motorsports says they have always supported the troops and flown the American flag proudly around their lot.

According to the United Stats Flag Code, no flag should be placed above or on the same level as the American flag. There are no penalties for breaking the code, nevertheless, many people believe it should be followed.

Glad they took it down, but one comment struck me as particularly strange when they talked to the dealership. They said that their flag had actually been blown above the US flag, but when you see the picture, the US flag is flying about half mast.

“says it was a simple mistake” If it was truly a simple mistake he would have swapped them months ago when they brought it to his attention.
He also said a storm had “ripped it apart” and he didn’t take down immediately? We learned as kids that if a US Flag is damaged it is supposed to be retired and disposed of properly.

To ignore this he must have been trying to make some point to people.

So, it has taken months for that new flag to come in? Please, Mr. Munn. Just tell the truth. You’re so busy selling cars you just didn’t give a s*** about the decorations. Right?

Other flags most certainly MAY fly at the same level as the American flag and frequently do. See http://www.ushistory.org/betsy/flagcode.htm

“No other flag or pennant should be placed above or, if on the same level, to the right of the flag of the United States of America, except during church services conducted by naval chaplains at sea, when the church pennant may be flown above the flag during church services for the personnel of the Navy.”

That practice was still in force on Navy and Marine bases at the time I retired, as they were categorized as vessels through tradition. Old Marines heading out into J-ville on LIBERTY often said that they were GOING ASHORE.

There is also a Jewish Worship Pennant and a recently approved Muslim Worship Pennant.

OMG. Thank you so much for clarifying this important issue. I was so worried about whether or not I should continue to fly the US flag on top of the other flags on the yacht THAT I DO NOT HAVE! Get a life.

Cliff: Yo missed one thing — it is USUALLY the custom to fly the US flag, but not always. In a maritime environment — such as the Carolina Yacht Club at Wrightville Beach or on a ship it is NOT the US flag that flies on top — rather the top flag is the yacht burgee (a temporary flag until a signal flag is set).

It is the maritime display with a “mast, yard, and gaff” which causes the most confusion. This puts the club burgee in a higher position physically, but not above that of the U.S. Ensign (flag) symbolically. By the normal Flag Code provisions, this would seem to be an incorrect display. The tradition of the seas, however, is to hold the gaff as the position of honor; thus, the intent of this tradition and display is to give proper respect to the flag.
