WILMINGTON, NC (WWAY) — To say the proposed Titan Cement plant is a hot button issue in the Cape Fear would be an understatement. Following mediation, a claim of slander against two Stop Titan participants has been resolved.

With the lawsuit against Kayne Darrell and Dr. David Hill out of the way, the Stop Titan group held what they called solidarity social.

Darrell is glad to have the lawsuit behind her.

“It’s been a little over a year, and I am very relieved to be able to put this behind me, and I am very much looking forward to being able to focus my attention in making sure our community has clean air to breath,” Darrell said.

The meeting Friday night had a mood of celebration as Titan opponents congratulated both Darrell and Hill, who each say they remain committed to trying to stop the cement plant from coming to New Hanover County.

Titan maintains that the cement plant along the Northeast Cape Fear River near Castle Hayne will operate in accordance with all rules and regulations. The company says it recognizes that reasonable minds have the right to disagree.

Meanwhile many people at the meeting say they will continue to try to stop Titan and they think the lawsuit should not have been filed in the first place.

“I’m glad they dropped the lawsuit,” Titan opponent Richard Polle said. “They never should have brought it. It was a bully tactic. I mean you had two citizens who were talking to their elected officials about a public policy about whether we should have this cement plant in our community.”

Both Hill and Darrell released statements regarding their comments that instigated the suit, and they say they will continue their opposition.

Dr. David Hill and Kayne Darrell released the following statements today through their attorney after settling a slander suit with Titan earlier this week.


I made certain statements about Titan America and its proposed Carolinas Cement plant before the New Hanover County Board of Commissioners. On further reflection, I could have been more careful in the words I chose to voice my opposition to the plant. I made the statements out of concern as a citizen of this community and as a physician and father.

I remain opposed to a cement plant being built in our community, but I understand that Carolinas Cement received its air permit and must comply with all state and federal regulations. Those regulations should help in reducing the adverse health effects, as intended by the Environmental Protection Agency.


I made certain statements about Titan America and its Carolinas Cement plant before the New Hanover County Board of Commissioners. As a concerned member of this community, I recognize that many may trust my statements as statements of fact. I made the statements out of concern as a citizen of this community and as someone who lives near the proposed cement plant.

I remain opposed to a cement plant being built in our community, but I understand that Carolinas Cement received its air permit, and must comply with all state and federal regulations, including limitations on emissions. It is my hope that those regulations should help in reducing the adverse health effects. Since my statements, it is my understanding that Titan’s subsidiary has been dismissed with prejudice from a price-fixing class action lawsuit, and in any event, I understand that the lawsuit contained just allegations, as I stated, and that they were not proven. I also mentioned court ordered mine closures of one of Titan’s subsidiaries. Since those statements were made, I understand the Army Corp of Engineers had issued new permits for mining in the Lake Belt, and all of the mines there, including Titan’s, are operational. To the extent that any of my comments left anyone with the impression that Titan had, in fact, engaged in price fixing or was in fact involved in corruption, that impression would be erroneous. My comments were never intended to convey that impression.

North Carolina ranks 11th nationwide in hazardous air pollutant emissions, according to a report released by the Environmental Integrity Project.

The report focuses on six toxic heavy metals—arsenic, chromium, lead, mercury, nickel and selenium—as well as hydrochloric acid gas. North Carolina ranked 11th in the nation for emissions of nickel, fifth for selenium and sixth for hydrochloric acid gas.

Long-term exposure to toxic chemicals can cause respiratory disorders, damage to the nervous and circulatory systems and a variety of cancers.

According to the report, emission levels of these pollutants by electric utilities have decreased nationwide since 2007, including in North Carolina, but electric utilities remain the leader in emitting airborne toxins. In 2010, they emitted almost 200 million pounds of hazardous air pollutants, almost twice as much as the next-worst industry.

Progress Energy’s Sutton Plant at one time released over 300 pounds of mercury every year, has a mountain of coal ash blowing onto the playgrounds across our area. And now we want more of this as Progress Energy converts to natural gas because they have to meet EPA standards?

International Paper in Riegelwood, Columbus County, is the region’s other big mercury emitter. Perhaps bigger than Progress Energy.

Mercury is a toxic heavy metal that’s especially harmful to young children. Mercury released in the air is deposited in water where bacteria help transform it into methylmercury, an especially toxic form that builds up in fish tissue.

The dangers of mercury exposure are well known and documented. Numerous peer reviewed studies have concluded that mercury must be controlled. The National Academy of Sciences – the nation’s premiere science policy body – conducted an 18 month review of mercury science and found that mercury in the environment poses a significant hazard to public health. The Academy found that more than 60,000 newborn children are at risk of neurological development problems due to mercury overexposure in the womb. The Centers for Disease Control and Prevention found that one in twelve women have unacceptably high levels of mercury in their blood.

Hard to believe some of you are willing to sacrifice our children (and pay for their treatment one way or another) for chasing a few dollars that will more than likely be little more than a living wage. No thanks we will make our stand and just say NO!

They intentionally and maliciously told lies due to their liberal and environmental waco views. These Titan opponents could do well to move if they are so concerned. Mainly they are a bunch of uninformed eggheads who are opposed to any factory coming to our area. They could care less about the proven economic benefits to our area. Most are well off and so selfish they would deny others the opportunity to support their family due to their self interest. These people are the so called “elite” who look down on a blue collar worker. They are the ones who attend the Azalea Festival social debutante functions that the common man has no interest or desire to attend. You know with their little tea cup and pinkie finger sticking out. They make me sick. Titan is coming and there is not a damn thing you wacos can do about it. Haha

Titan gave them the opportunity to set the record straight rather than make them pay a cash settlement. The two protesters had to eat crow and walk away with their tails between their legs. Good for Titan for letting them off the hook.
Time to move on to the next BS issue.

Wilmington and New Hanover Co. are cesspools of corrupt politicians who will NEVER do the right thing for its citizens. They will welcome this pollution factory and take their kickbacks, they’ll build a $40 million baseball stadium that no one wants to help out their real estate cronies, and they’ll call women “irresponsible” for having sex and seeking birth control.

And the voters keep putting them in office. You will get what you deserve. My family and I will be moving to Asheville and good riddance to this backwater!

I’m sure the Titan will be much nicer and more sensitive to you as an individual once they inflict prosperity on your area… conform, comply, resistance is futile etc… Hey if we pave the river (with concrete of course, please God don’t sue me) we won’t need a bridge.

If one makes false statements publicly, then one should be ready to be called to account. I see from the follow-up statements that there was some backpedaling by those who made the false statements.

Give this a rest. It’s over and Titan is coming in to our area. We’ve had so much bad publicity for our area in so many ways. My family in another state knows as much as we do about what goes on in Wilm and New Hanover County. If I was thinking about opening a business here I would tuck tail and run in another direction. Please. Monitor air quality all you want but it’s time to be quiet and let this calm down. Between the mayor and city council and the county commissioners we are a laughing stock.

Hope that none of you people that are against Titan don’t work at GE, Louisiana Pacific, Vitalic, SAS, Weyerhauser, or any of the other Industrial plants that are located off Highway 421 and the surrounding areas. Oh thats right! These companies have never polluted anything. Maybe we should look into running your jobs out of this area.

Things like the disaster in the Gulf of Mexico can not happen in the United States. The government always does what is best for all the people! So…….What the hell happened? With trillions of dollars profit in the bank, a dead man valve on the sea floor was deemed too expensive and unnecessary. This disaster will be felt for many years to come. Peoples livelihoods changed/destroyed forever. Why? So a foreign corporation can profit at our expense! This example of profit ahead of everything else is a curse that will keep on cursing. Big government + big corporations = screwed citizens. Castle Hayne, North Carolina has a chance to learn from this. Look to Alexandria, Egypt to see how Titan operates when no controls and regulations are in place. Check and see how much money has been spent by Titan lobbying Congress to reduce and eliminate pollution controls in this country. Check and see who is behind the push in North Carolina to reduce and eliminate pollution controls. Now tell me Titan cares about anything other than Titan, just like another foreign corporation that destroyed the Gulf of Mexico 2 years ago. The mess in the Gulf is a reality, the only recourse is to continue the clean-up. Titan can be prevented. Titan’s pollution does not have to happen. Titan’s massive water usage that will probably cripple the aquifer that thousands depend on for their water does not have to happen. All the citizens have to do is stand up and say no. Demand action from elected officials. Get involved, or, you can be like an ostrich…….stick your head in a hole and wait for others to solve the problem. If so, don’t forget what is still stuck in the air to be shot off………………………….and you can depend on the government to look out for your best interest, just like they did in the Gulf of Mexico.

Titan operates a lot like our government, bait and switch, put out statements designed to divide the public. This prevents them from having to answer questions themselves. It took Titan approx. one year to file the lawsuit from the time the statements were made. Either their reading and interpretation skills are lacking and extremely slow, or this was a well thought out plan to remove the focus from the plant being built. Like a bully that finally gets punched in the nose, Titan went and “cried” to the courts. A multi-billion dollar corporation, too intimidated to make a phone call to two citizens to resolve a dispute. If these statements were so terrible as to result in a lawsuit, why did it take you a year to become upset? If Titan plans to resolve all of its problems with lawsuits, our courts will be plenty busy. May-be this is where all the extra jobs they speak of will come from. Titan plays this controversy like a poker player holding a royal flush, smug and sure of themselves. May-be you feel there are enough chips in play to secure your victory, but understand you are going to be fought every step of the way. As far as this air permit you are so proud of, the division of air quality has never turned one down. What a compelling victory this was. Hope you are proud of yourselves, because this lawsuit just shows how petty your corporation is. Big surprise that Bob Odom chose not to make a statement, he never speaks without a script, and refuses to ever answer any questions in public, even when a County Commissioner makes the request. People with nothing to hide have nothing to fear. Enjoy your victory cigar, this lawsuit is something you should really be proud of.

Guest MD do really believe the rhetoric you are spouting off about? You clearly have no clue about and live so far out of touch with reality you should seek professional counseling at the earlist convience.

I find you condescending demeanor of chasing dollars for a mere living wage extremely offensive. I also find it offensive that you a supposingly a professional medical expert and the other so called concerned father and doctor would use your posture and position as so called professionals in a manner that would cause panic or disdain. The licensing board for North Carolina should review both of your actions and demeanor as trusted members of soceity as soon as possible. You are not allowed to render such opinions or act in said manner because you are held to a higher standard of conduct.

By the way, I could of spent hours upon hours researching and posting numbers and statistics, but what would be the point. The elite crowd in Wilmington tend to drive politics in the area. But bear in mind, you can twist numbers and statisical data anyway you want to show what information you want. I can die driving a car, but should I not drive anymore?

So, I say to you and the Stop Titan movement. This is an outrage. Your conduct is highly unprofessional. Your theories and ideas are perposterous. Your intentions are highly questionable and should be regarded as suspect.

It is easy for you to render such judgment when money is not an issue. I am sure you are more than capable of providing for you and your family through your practices. Which, I hope, go away because of your actions and conduct. If you truly believe in medicine and the premise of the Hippocratic oath, then you should be practicing medicine for free. Don’t piss up my back and tell me it is not raining.
