CHARLOTTE, N.C. (AP) - A lawsuit says Swain County social workers knew that a 15-month-old North Carolina girl's life was in danger but failed to take action on complaints that could have prevented her death.
The complaint is being filed in Swain County Superior Court on behalf of Aubrey Kina-Marie Littlejohn's estate. She died in January 2011.
Family lawyer David Wijewickrama says he wants to find out who was responsible for the girl's death and hold those people accountable.
LadyBird Powell is Aubrey's great aunt, and she has been charged with second-degree murder in Aubrey's death.
But the lawsuit filed Wednesday names Swain County DSS as a defendant along with seven current and former social workers. The lawsuit is seeking more than $10,000 in damages.
Calls to Swain County DSS were not immediately returned.
