FIRST ON 3: Former BSL chief Ballree, son indicted on gun charges

BRUNSWICK COUNTY, NC (WWAY) -- A Brunswick County Grand Jury has indicted former Boiling Spring Lakes Emmett Ballree and his son.

A spokeswoman for the NC Attorney General's Office says Michael Ballree faces one felony count of possession of a firearm by a felon. Emmett Ballree faces one felony count of aiding and abetting.

According to the indictment, back in September, Michael Ballree had a Heckler-Koch UMP .45 caliber automatic weapon. The indictment says Ballree was convicted of felony possession of a stolen firearm in Wayne County in 2004.

The indictment says Emmett Ballree aided and abetted his son to possess the gun last fall despite knowing that Michael had the conviction on his record.

When reached by phone this afternoon, Emmett Ballree said he had nothing to say about the indictment. A phone number for Michael Ballree could not immediately be found.

Do you know how many times he drove his own vehicle on Police related calls because that was the quickest way to get to the call from family or personal events. I mean yes he could have drove all the way to the station or his home where his town car was, but no he wanted to go straight to the call and handle the call ASAP. He was a very good and honest Chief. I'll always look up to him for that.
His son:
Emmett just wants to be the best Dad he can be for his Son and Daughter. You can't tell me other parents have not bent the rules for their kids. I don't know many other men that are as good a person as Emmett and I guess in the long run that was his downfall. Being such a good person made others jealous and they couldn't stand it and had to find some fault to try and bring him down so that they would feel better about their self.

I find it humorous that folks are "bashing" on Ballree because he is such a "good family man, and person" and that people are "jealous" of him. Yes, I am jealous of a man that has broken the law, has been fired from the BSL PD and had to quit the Mount Olive PD and has a felon of a son that has to be transported back and forth because of his felon conviction.

Do you find it ethical to have an employee of yours transport a family member back and forth to their place of employment while on the clock in the company car? Do you find it ethical to provide an automatic firearm to a convicted felon?

You, my friend, need a serious wake-up call. Ballree was unethical and a disgrace to law enforcement even before Kinney and Lewis brought him to town.

Jonathan, you are way out of line to tell anyone "...keep your mouth shut." Further, you are quite the fool to think all in this city are so blind. I am sure you are convinced Emmett is a "..a good family man and person." He must be to his family and it is obvious you are one that feels a great deal for the man but, that does not change any facts nor does it excuse him from violating city policy and the law. (need a ? there btw) Well, you must know that he rarely if ever had a family car available to him and he used the city car to get to work and back keeping it at home. So, that means if he did go on a call it was in the city car and not the family car. I challenge you to prove one event in BSL since Emmett got here that he responded to a call in the family car. You know you can not. So do not even begin to talk about how he did not want to drive from "home to the station" to pick up a car as he has NEVER had to do that here in BSL. You may look up to him but he has not been a good an honest Chief here in BSL. He has driven miles and miles, running out hundreds if not thousands of gallons of gas for personal and family use. That was never the deal when he came here and he knows it. Now you talk about how he is a great father to his son and daughter. I do not think anyone would question his love and dedication to both but, there is a time to take a tough love stance and using city funds to cart them around to work and court appointed meetings is not part of his compensation package either and is not the burden of the citizens here in BSL. Also, let's not forget we are not talking about young and/or adolescent children here. We are talking about adults closing in on their 30's!

There has been no jealousy here. Certainly it was no effort to find fault. Emmett Ballree abused his authority. He used the city vehicle for personal use. He further ignored the law and that has brought him an indictment. All of this is in his hands and his hands alone. You are insulting people to say anything less and that certainly does not bring any sympathy whatsoever to his cause. The city has said enough and his "sponcers" are gone. Even his own officers have come out against him. Is it possible that (as he would want people to believe) that eveybody is out to get him? Or is it more likely that not everyone could be wrong so therefore he is the problem?

Emmett Ballree is standing exactly on the spot the road he chose and followed took him. Do not insult this town by saying different and certainly do not insult those that stand up and tell the truth by saying, "shut up". Get used to the fact that we will not. We will not allow our town to be abused anymore. The people of the city just want a police chief that is honest and above board. One that understands the law and one that does not violate city policy.

I think this absolutely ridiculous. first Ledbetter, now Ballree. shouldn't mister Richard White be n ext? all his offenses never went to court, but instead were hush hush so the city wouldn't find out, sand instead "RETIRED" this entire city is a disgrace. get all these corrupt fools out.

A Time For Peace and Healing

If you look at all the comments I think all could agree that the full gamut of opinions and thoughts have been run. It would be reckless to state there are not any strong feelings on all sides and mostly there is cause for these feelings. But what is done has been done and it is impossible to go back in time and undue any of it. Extreme steps have been taken in BSL in order to address the concerns. The law has now stepped in and the process is now in the hands of the court. The final outcome will be addressed in the courtroom and not in our city or in this blog. Since everything that could be said on all sides already has been said and at length I hope all will consider now is a time to pick up the pieces and move forward here in BSL. Let the past rest and let the courts do their job. Let's not take another look backward except only to make sure we do not repeat any past mistakes. Let's put down our verbal and written weapons and move forward now. After all, have we not all had a bite at this sour apple by now. Have we all not had our chance to let off steam and get said what we want to say and on all sides of the issues? Now let's together think of our city and get back to positve and productive work.

I agree wholeheartedly. There are good things happening in our city now. We are running our local government efficiently. We are taking steps to improve the infrastructure. It is time to move on and continue progressing.

The Legacy of the Wicked!

It has been a long time coming. Way to long but the day of reckoning is here. Most know the story but not all of it and it is time for WWAY to go get the rest of it from those that brought this upon our city and ask them what they were thinking and what their motivation was? WWAY, run down former city manager David Lewis and ask why he hired Ballree when he (Lewis)knew full well Ballree's history. He knew full well Mouth Olive city manager Charles Brown stated publicly he had viewed the video of Ballree putting gas in his personal vehicle and charging it to the city. Brown also stated he believed the city had all it needed as far as proof. Ballree chose to resign rather than face their city council. Ask David Lewis when he sent then Chief White to do the background investigation if Chief White recommended Ballree for the job. Ask Lewis if he felt that all was OK with his choice when he found out the NC Training and Standards would not give Ballree a certification to wear the badge and was it normal practice for a city manager to have to travel to Raleigh and plead for a temporary certification. Next question former Mayor Joan Kinney on how much she knew about Ballree when Lewis was making the hire as she was the only person from the city council that sat on the committee looking for a new Chief. Ask them both did they know about the criminal history of the adult living with Ballree and if they did not, why did they not know this? Ask why Ballree's continued abuse of city funds was covered up and ignored by the last city council or at least a majority of that council.

Folks, some will get on this blog and offer up all kinds of opinions and excuses but none will have any basis of fact to substantiate their opinions. This city at the hands of David Lewis and Joan Kinney brought to you a police chief that had no regard for city rules, abused his position, used city resources for personal gain and now has been indicted on a felony charge. This is the legacy of David Lewis and Joan Kinney. And of course they were fully supported by a majority of past council all of whom should be identified for that support. Even today their are board members who will tell you how Ballree is so hounded by others and they not only turn their backs of the facts but support him with all the facts now laid out on the table.

When you see Ballree say to the media that he has done nothing wrong. When he states 'others' were after him remember, this is the exact same tactic he used when he left his job, in shame, in Mouth Olive. And media, dig just a little deeper into his past and into those that supported him. Ask why and then tell the citizens of BSL what they have to say now.

We now have a chance to move forward toward a new era. We can now search and find a good and respected person to take care of the needs in this city by being a pristine example of law enforcement and a role model for all the officers on the force. The citizens as well as the good officers deserve this and it is about four years past due. The good news is the refuse is on the curb and the new day is upon us. The truth has prevailed and the lies and the cover ups have at long last, failed.

Thanks David Lewis and Joan Kinney for the blight brought to our city and thank you Emmet Ballree for your lack of service and your ingratitude to this city by turning your back on a undeserved second chance, continuing your path of less than ethical practices. This time Emmett Ballree, please show a little more class than you did in Mount Olive and drink from the cup you yourself have poured rather than go to the media blaming all and anyone else. When asked by the media, admit your guilt or simply state, no comment.

To all of the supporters, advocates, enthusiast, fans, patrons and groupies of Emmett, including Commissioners Mike Forte and Craig Caster, please take note of how much of a "good guy" Ballree is and, once again, how much shame he has brought to this city. Providing an automatic weapon to a felon is not only dangerous, but twice as dangerous when the felon's conviction was possession of a stolen firearm!

The support that Ballree received when first hired was beyond gracious for having such a background, but then having the audacity to commit such a crime after having a multitude of "incidents" (convicted, suspected, alleged - whatever they may be), is surly career suicide. I'm glad that he is "looking at careers outside of law enforcement" - his leave from the field will "make the world a safer place".

To Commissioner Forte, who has commented previously on these discussion boards (as tacky as that is for a city official to do) after Ballree was fired less then a week ago, stated "How sad that a man has lost his livelihood, his career and the ability to support his family and some of you feel the need to trample on his grave. How sad and small of you." I hope your eyes are as big as your ears and you can read that this scum bag has not only mis-used city resources (gasoline, vehicles, on-the-clock-employees, etc) but has also armed a convicted felon. "Forget Forte: 2015"

I don't see where I said I supported anybody only that it was in poor taste to continue to drag the man through the mud. Apparently you feel differently and that is your right I suppose. I did however put my name to my post unlike you or JohnQBSL who are afraid to come out of hiding and put your name to your posts. You are not fooling anyone with these names and we know who you are. Mike, you say, "I don't see where I said I supported anybody...." but, even Ray Charles, blind and dead can see from the grave where you stand so let's not pretend anyone sees things differently. But you do raise a good point and one that is worth exploring a little further. It is a fact that while a majority of the past board turned a blind eye to Ballree's antics none on that board can be 100% removed from culpability on Ballree staying in his job over the past four years. All five new of this and not one stood up publicly and shouted out the truth. So while there have been different levels of culpability all of them to some extent even if a lesser extent have this on their shoulders. You and Glidden came into this after it had already been going on and did not bring this to our town but, only you have shown sympathy for the person that cheated our citizens and betrayed his oath. So, out of all of you only Glidden has remained completely clean of this terrible, ethical, and criminal (now) contempt against the citizens of BSL. It has to be assumed she has decided to allow business run as it should and without comment as she has offered no comment and was not part of the past selection of Ballree and then the ignoring of his antics. But in any case she has very wisely kept her mouth shut. White and Carroll, why did you not protest louder and longer?

Wont be long before the AGs office and SBI come down with indictments against Blasingame, Jayne, Delapia and the rest for corruption and other acts, of course they'll have to find another prosecutor due to conflict of interest because Jon David woofully all but covered up the actions of Jayne and the others. Sad Indeed to say the least.

Thanks again Joan! First you nearly bankrupted the city by hiring David Lewis. Then you hired this guy(Ballree)who you knew had a ton of baggage with him. Your decisions have made us the laughing stock of Brunswick County. Thank God you're out of there. I hope the County GOP Headquarters' people keep you at arms length, before you bring them down.

Now it seems we have a new Commissioner with a poor judge of character trait. Keep a rein on him before he brings us back down.

It was a full auto

Don't know where you are getting your info but the weapon in question is indeed a fully automatic rifle. For those of you that are not up on firearm lingo, a fully automatic weapon when set on full auto begins to fire when you pull the trigger and continues to fire until you release the trigger or empties the magazine. Many lay persons would know this type of weapon as a "machine gun". Most likely the magazine being use held around 30 rounds. The BSL police department owns one of these. So the fact is you are wrong and this is not just a semi-auto version but a full-auto version and by the way, that is how it was fired on the range that day by the younger Ballree.

YOU ARE WRONG!

Not only are you wrong in your statements but apparently you can not read. The post clearly states that "lay people" would call this a machine gun and if it is fully auto, that is exactly what a 'lay person' would call it. Your statement that 'most' UMP.45's are semi auto openly displays you should have knowledge that some are fully auto. Now, so you can get factual info and not stick you foot back in your mouth, what the city owns and does not own is public record. Simply take a moment to call the city or even the PD and ask the question, "does the weapon in question have fully automatic capabilities"? When you get the answer you are more than welcome to come back and post you misspoke without checking facts yourself and the weapon is definitely a full auto version.
