BRUNSWICK COUNTY, NC (WWAY) — A Brunswick County Grand Jury has indicted former District Attorney Rex Gore for allegedly signing off on false expense reports for an assistant district attorney while in office.

According to the indictment, Gore, who served Brunswick, Columbus and Bladen Counties signed off on ADA Elaine Kelley’s expense reports claiming gas money in excess of $14,000 that was not eligible for reimbursement. Gore allegedly told Kelley to claim travel that never took place.

Gore is charged with felonious conspiracy to obtain property by false pretenses.

The Grand Jury also indicted Kelley for obtaining property by false pretense and felonious conspiracy to obtain property by false pretenses. According to court documents, Kelley filed reports falsely claiming she drove from Elizabethtown to Bolivia at least once a week for five years for work.

Kelley has not yet returned a phone message seeking comment.

In a statement, Gore said: “In the spring of 2005 I hired Elaine Kelly to supervise prosecutions in the Bladen County unit of the District Attorney’s office. Because she was going to be commuting 500-plus miles per week, I included a travel component in her compensation package. It was a choice that I felt I could make because of the broad discretion the elected District Attorney has in handling compensation issues. I had several options available. In the end, I chose a travel mileage plan that limited her to 125 miles for commuting. I have no reason to doubt that each week she claimed that mileage; she consistently traveled at least that many miles. Shortly after I left office at the end of 2010, my authority to approve that compensation package came into question. Eighteen months later my decision has resulted in this charge. I had no intent to overstep my authority.

“While I am disappointed and disagree with the decision to prosecute, I am a strong believer that our jury system is designed in such a way that we ultimately reach right decisions. I am anxious to get this controversy resolved.

“Even though we have entered this current phase, I still take comfort in three things: I received no monetary benefit from my choice; Ms. Kelly received no more money than she would have had I chosen a different compensation package method; and Bladen County had one of the most aggressive, effective prosecutors in the state when she was there.

“I hope that this issue over one of my administrative decisions does not cast a shadow over the great work that prosecutors and staff in the office of the District Attorney have done over the years and continue to do now.”

  • You have given me a few things to think about. I agree that the wound photo should have told anyone that this was a murder, execution style. Gore never did seem to comprehend that.

    According to you, the men on the police force (at the time her troubles began, she was the only female on the force) were afraid and under great stress that this woman’s mouth was going to get them all killed by drug dealers. How would you know this? Also, should their great fear excuse their behavior and some of members of the fire department for beginning the false gossip about her and one of emt’s, which later progressed to her filing a law suit? I know she tried to do her job and many of the rich and famous didn’t like getting tickets, even though they were breaking the law. They were always leaning on the powers that be to make her void their tickets.

    Since the county and the island have heavy Mexican international drug trafficking, and no one doubts that, I wonder why the former sheriff or the current one, the SBI, and the FBI have let it continue? Maybe because some of the deputies from a while back could tell about setting up a temporary air strip in Green Swamp for a drug plane to land. Or something similar. But in this time of national security concerns, I would think the traffic on and between Bald Head and Southport ought to be watched constantly. Where is Home Security?

    It is strange that you think sweet Davina did not know those she confronted. I have heard many of her friends say her voice sounds cautious, but not afraid. As a matter of fact, the DA’s office made a big deal out of saying she sounded so calm because she was alone and going to kill herself right after she said those words.

    I am glad that you have solved her murder so simply: however, I know some locals were over there as well and up to no good.

    And I find it unconscionable that you advise the family to go to counseling to accept that the international, ya-da, ya-da killed her. I think you meant to say, go to a hypnotist.

    I also find it interesting that you think the current DA cannot solve the case, is no closer than he was, etc. First of all, how would you know? Do you stay in touch with workers at the DA’s office who still support their former boss? Do you also play golf on Fridays?

    As far as yellow-bellies are concerned, you are saying that the former DA knew in the early hours of that Saturday morning that three Mexicans killed this officer. And they can never be found. Then he should be held accountable for not doing his job. Also, how did he know they were guilty? The people of the county and others across the nation would like to know. As for where to find them, all I will say is they were found later. And it certainly wasn’t too hard for the interim BHI police chief to find them. But he didn’t do it through Gore or BHI officials.

    Rex Gore lying about suicide probably means he knew the level of
    violence that could then happen to his own family.Yellow-belly yes.
    The behavior you describe –her being harassed
    by co-worker officers is not uncommon when other officers are
    very stressed, about your daughter possibly
    uncovering payoffs from drug cartels, or other officers
    also worried about being shot in that heavy mexican international
    drug trafficking waterway and highway area of Brunswick County. This is not the first case of internationals attempting or actually murdering officers or prosecutors, read all the numbers of those who have been killed since the war on drugs started. Another very similar case happened that came wihin an inch of turning out the same way. The officers who stumbled on the Noriega drug smuggling
    boat in the early 80’s were faced with being outnumbered
    when they boarded the vessel.So, they left the scene
    before returning with backup agents to make the seizure and arrest.
    News articles and books were written about this event but

    being confronted with a gun by 3 people.It may never ever be solved with the shooters being international
    drug smugglers. Try weekly counselling to try to resolve in your mind that this is what happened.
    Nothing anyone and especially any politician can change by political exploitation of her or your family any further. Stand up for her memory and clear her name, yes. But don’t fall victim a second time to a person who is only seeking headlines and is no closer to naming the shooter than the people in charge were back when it happened.If you were in those shoes and knew the next day the 3 internationals with false id’s did it, how would you go about finding them?

  • You do see the Good Ol’ Boy System at work – keeping Gore out of trouble by selecting a pitiful little argument to bring charges about instead of really going after him. This is a state investigation, handled by the Attorney General, a Democrat, who has been sitting on the supposed investigation of Gore for several years now. This is not Jon David against Rex Gore. You have your own little power players still protecting their own, just like they did Ron Hewett.

    BTW, if he is SO innocent and surprised, why does he have two high-powered attorneys covering his behind?

    OMG how selective the reading and statement of facts are in this blog from the Hewett/Gore deciples. One states how Gore did nothing wrong and goes on to say, paying mileage is fine. Well heck yes it is if, you drive the miles BUT only if you do so. You don’t get to sit on your butt in your cushy office and get mileage but, Rex Gore paid it and he paid it on the dime of us taxpayers. You Hewett backers know what a crumb Gore is. He stood hand in hand with Ronald while abusing the system and breaking the law but he was no where to be found when Ronald rightly was sent off to jail! Except for throwing Ronald under the bus! Now the hens have come home to roost and Gore is going to get his day in court at long last. And by the way you whiners that still can’t get over Ronnie being jailed and now Rex being charged, get over it. There is a new DA in the county and your small little group posting in here comes no where close to being a number that can change that. Thank you Mr. David for enforcing the law. Lastly, Thank you for taking up the old and ignored case of officer Jones on BHI. With all that was destroyed in evidence and all that was covered up with the OK of the past Good Ole Boys, you may never be able to get to the bottom and to the truth but God Bless you for tying. I hope His power will help you uncover the crime and corruption where due punishment may be handed out and real closure and peace can come to the Jones family.

    The David boys are fine examples of how to manage local, state and federal money. If the public only knew!!! Their day, both of them, is coming. I am pleased to see the post regarding the David’s game playing come election time. Unfortunately I am not certain local law enforcement sees this. Funny how they were eager to charge the officer in Payton Strickland’s death… a non election year. Come the next campaign period, they were ready to regain the law enforcement communities trust by charging the drug dealers with a cop’s death. Wake up people of Brunswick, Bladen, Columbus, Pender and New Hanover counties.

    This is nothing but political retribution. A serious waste of taxpayer money. I read the article expecting to learn of some crime. The Asst DA was paid mileage, just like everyone of you would expect to be paid if you were travelling for your job. And the Good Ol’ Boy System dead? Sounds like it’s alive and better than ever, and we can include some Good Ol’ Girls in the system now.

  • After contemplation over the last few hours, I realize that any celebration on the indictment of the former DA here was premature. I now believe that this was all set in motion from the judge who claimed to have received information that had to be investigated, to the two ‘outstanding’ lawyers defending the former DA, this is a show designed to bring as small a charge as possible, follow a sham of court, and let this former DA off without having to bring charges concerning any of the terrible deeds this man and his cronies have done. It is the pattern they used with the former sheriff. It is over an amount of money and has nothing to do with the atrocities committed in the name of the law over the years.

    For all the victims and families I know all across this country, I have some idea of the frustration you face, knowing that Lady Justice has not shown her face to you. She wears that blindfold because she does not want to see what the courts and this country have become.

    I can only assure you that when the event happened in your life, it is the same with my sister. She did not die alone that night. Somebody saw everyone involved: the ones who left on foot, in boats, and in golf carts. They saw all those land owners who were too concerned about their property values they demanded a verdict of suicide. They saw all of those who fashioned this execution and cover-up. They have the power to burn these guilty parties no matter how much power and money they have. And it will happen. Nobody gets out of here alive. Then the smoothest, highest priced lawyer will do them no good.
