BRUNSWICK COUNTY, NC (WWAY) -- A day after allegedly causing a fatal accident, a Brunswick County Sheriff's deputy is temporarily off the job.

Dep. Adam Locker was on duty when troopers say he turned in front of a motorcyclist on US 17 near Calabash.

A small bouquet of flowers and a bloody cloth are small mementos that signify something bad happened at the intersection where Thomas Varney, 57, died Monday. He was riding his Harley-Davidson on US 17, when troopers say Dep. Lockner turned in front of him while responding to a domestic call.

"When he took that left off 17 North, he cut across 17 South and didn't see the motorcycle," Tpr. J. Thomas, who is handling the investigation said.

Varney was from Virginia. He and his wife were on vacation in North Myrtle Beach, SC.

Investigators say Varney had ridden to Beach House Harley-Davidson in Brunswick County, but the the store was closed. He was on his way back to South Carolina when the accident happened.

EMS airlifted Varney to New Hanover Regional Medical Center in Wilmington, where he died.

"I can tell you alcohol has all been ruled out," Tpr. Thomas said. "He was tested at the scene, just as normal procedure would be. At this point, alcohol is not believed to be any type of contributing factor."

Highway Patrol charged Lockner with misdemeanor death by motor vehicle and failure to yield. The highway patrol reconstruction unit will investigate Wednesday.

Dep. Lockner has been with the Brunswick County Sheriff's Office since October 2009. He is currently on paid administrative leave.

5 months ago I said goodbye to my husband that Monday morning as I headed to the beach with a friend and he downing a huge dagwood sandwich before his "ride". He was excited to be on vacation, had spit shined that bike. I wish I could take that morning back and say no, go with me to the beach..he did that on Sunday you know..something he hardly did. We walked on the beach holding hands, talking and just being happy together, we saw a bird fly down and get a catch in awe. He was a man of faith and encouraged the same from me. I can't begin to tell you of the loss I feel or how many "occasions" have come and gone without him..Thanksgiving, his 58th birthday and birthweek we'll never celebrate again, unless its September 17th @5:00 and Happy Birthday in Heaven, his church family misses him, his son misses him, his grandchildren, his best friends and his Carter Family, his Belfry Ky family mostly ME HIS WIFE. My home and heart are empty.
I pray for the officer involved as I know he didnt intend to do this but also know that he is sworn to uphold the law. I hope like me, he sees the vision of my husband as I see it every day when I awaken, every night when I close my eyes and try to sleep. He didnt deserve to die this way. He has been a rider for 35+ years, and his occupation, he drove 1000s of miles a year. A safe driver. I know we cant change what happened but in all of this know that the comments are not meant to be hurtful but to give insight to the awesome human being God chose to take home instead of allow to suffer as a result of this horrific day that I will never forget.

Accident

It was an accident..Why do people want to make the people involve feel worse than they already do..I doubt that the Deputy was on his cell phone. He was in a hurry responding to a call..it could have happened to any of us that was in an accident but people want to make a big deal out of it all because it was a Deputy...well guess what? HE'S ONLY HUMAN!!! Now on the subject of Deputy's using cell phones, I was in the car with a deputy that all the way from Shallotte to the Sheriff's Dept he was texting and driving 80 miles an hour most of the way there but why report when it's your word against their's...I know I didn't report it just because I figured the Sheriff wouldn't believe me but I know what I saw and I know what he did and I figure if he did it with me in the car that he did it when I wasn't in the car.Facts are the facts and he BUSTED THE DRIVING WHILE TEXTING LAW ALL TO HELL AND SPEEDING MORE THAN 25 MILES OVER THE SPEED LIMIT BLOWN WIDE OPEN AND GOT AWAY WITH IT AND WILL CONTINUE TO DO SO....IT GIVES POLICE OFFICERS A BAD NAME.

Everyone needs to stop using

Everyone needs to stop using this as a B*tching forum about other events in the past! Everyone needs to think that the families of both the victem and officers, might be reading this and finding this very offensive! Instead of using this to talk about past events that do not have any importance to the pain, suffering and grieving of both these families how about using it to send good thoughts and things that are going to help the families especially those of the victims because they have lost a very special man in their lives! First, and foremost, my

First, and foremost, my heart goes out to the victim, and his family. Just like the anbulance driver, it was a tragic mistake. It's so easy to look at a public servent, and think "he should have known better". But we all make mistakes, driving. Usally, we are lucky, when nothing happens. (You accidently run a red light, but luckily, there was nobody to hit.)

Fate just happed to deal a cruel hand, on this occasion. I feel very sorry for the deputy, who, I'm sure, feels very bad, right now. He never meant to hurt anyone. It was a mistake.

My husband was the ambulance

My husband was the ambulance driver in that tragic accident last October. When the case was finally closed earlier this month, my husband was in the parking lot after court preparing to come ho.e and the victim's friends approached him, hugged him and told him that they forgive him. The victim's family also requested that my husband serve no jail time. No one knows the hell our family has gone through this past year and I am quite certain that Sarah's family has struggled also. My point is this WAS AN ACCIDENT CHILDREN (because that is what all of the negative commentors sound like); What all of the people involved need now is your support, love & prayers; not your driving record, criticism or "assessment" of the situation. GROW UP & HAVE SOME RESPECT!

This is very sad for

This is very sad for everyone involved. Especially since it could of been avoided. I had a Sheriff pull out in front of me today on my way to work. He didn't have his lights on. When I passed him as I turned right onto 17 I saw he was on his cell phone. It wasn't like he pulled out in front of me and I had to slow down, it was he pulled out in front of me and I had to slam on brakes. I drive on 17 every day to work and the speeding, the cell phone use, the overall poor driving some cops use is very common. If our deputies aren't following safe driving laws why the hell should we? Lead by example BC Sheriffs

OUT OF CONTROL

I have seen this time and time again. I travel to work on hwy 17 and also work in the area. It's not only the BCSD it's also emergency vehicle's. They stay in the left lane and with no emergency flashers on and speeding. I want to encourage everyone to lets start calling 911 or the SHP and let them know that they are breaking the law. I am starting today, and if I see a BCSD car or the EMS riding in the left lane you bet I am going to call.

Luckly the 20 other law

Luckly the 20 other law enforcement officers I witnessed responding at extremely high rates of speed, with lights and sirens, did not add to the death toll in this unfortunate killing.

You know this is a lost to everyone involved...yet you want to dig up the past and run off at the mouth about stuff you have no idea about. The Deputy involved in this tragic accident is a good man and is a great deputy. He had a accident and now someone has lost there life. It was a ACCIDENT and he was responding to a call. Not like the THUG in Wilmington running from the police dept. You are a clueless individual who needs to get a life. We work the roads catching criminals, in schools protecting your children, work funerals to make sure the deceased and their families get safely to the deceased final resting place, we don't make a lot of money yet we are willing to lay down our lives for someone we don't even know, we work constantly in the heat, rain, hurricanes, storms and cold so you my friend can sleep safely at night. And should you need us I am sure you will dial 911 for that same person you are being so critical of to come and save your butt. You have no idea what it is like to go to a call and not know what you are pulling up on. Whether or not you are going to come home to your kids and family...so do us all a favor and keep your derogatory remarks to yourself...you are doing nothing but making the situation worse.

The motorcycle driver was my sisters father in law! He was a very safe driver, a loving father, grandfather and person this accident was the OFFICERS fault he did not yield! I appreciate all the prayers and nice comments others have said. The family is very sad and devastated right now! They need all the prayers they can get.

In your rant you mentioned

In your rant you mentioned citizens gets tickets for going 2 mph over the speed limit and that nothing happens to cops who kill people. First, please show me who on earth was cited, or even convicted of going 2 mph over. Secondly, you must not have bothered to read this very article you posted under. The deputy involved was charged, yet there you are spouting on about free vacations. Sorry a security guard stole your girlfriend or whatever your gripe is, but you are wrong to paint all law enforcement with such a wide brush.

Very well said and represents what the majority of civilians are thinking and observing, and if the road wasn't dangerous enough, now we got BC deputy's flying up and down the waterways in boats, what has happened to wildlife, marine patrol, and coast guard, did they all get layed off?

Whats Good For the Goose..

oh remember the wilmington police officer that got killed on a way to call because of a box laying in the road and they blamed his death on the guy they were pursuing..now, that the criminal they were pursuing in New hanover county didnt get misdeamnor death by vehicle but yet this cop caused someone's death responding to a call, shouldnt the same applied in this case? Oh thats right, this is a white guy versus a black guy except the black guy didnt actually kill someone..Oh Ben David..make a call to your brother in BC.

Felony vs Misdemeanor

In the New Hanoner County case, the individual charged (and convicted) was involved in a felony, therefore, the felony murder rule applies which implies that when an offender kills accidently or without specific intent in comimission of a felony, the offender can be charged with murder. In the Brunswick County case, the Deputy Sheriff (nor anyone else) was involved in a felony, the death was unintentional, but the Deputy's action (pulling into the path of approaching traffic) was a misdemeanor (or as you spelled it - misdeamnor). A law enforcement officer's career is over and he will have to live with this for the rest of his life and, more importantly, a man lost his life. It is disgusting that, in your ignorance, you would attempt to make this a, racial, issue.

First of all the "black guy" was a drug dealer who threw drugs out of the car and was running from the police.i can't believe how some of you people react towards law enforcement. two families have been devastated by this and some of you want to make it into a police bashing forum. come on.

The circumstances there were totally different that guy in wilmington was running from the police. If you are innocent then y run? O yeah thats right because he wasnt innocent. There were aggrovating factors in the one in wilmington. Here u just have someone responding to a call and didnt see someone else it was just an accident. I dont understand y people always make it about race? It had nothing to do with race. Grow up.

There was an accident and the law enforcement made a mistake. It's not about race, its about praying for 2 families hurting from the incident at hand. So, if you want to say something, just pray for the families.

Motorcycle Accident

My heart goes out to this family. I lost my husband two weeks ago in a motorcycle accident at the intersection of Hwy 17 and 87 in Winnabow. He was only 53 years old and loved to ride. There is no one to blame for my husband's accident because he did not hit anything unless something come out of the woods in front of him. The officer in the above mentioned accident will need our prayers as well as the deceased family. The Lord said your days are numbered and we can not question his words. Please love your family a little more today because you may not know if it will be the last time.

Sorry to hear of your loss Kara, our thoughts and prayers are for you as well. My husband was a co-worker and good friend of the man that was killed Monday. He is in such disbelief right now and finding it hard to accept Tom's death. So many people are quick to point the finger but we all need to remember that the officer truely did not mean to hurt anyone. He will need our prayers as well as the Varney family because this is something that will have an impact on the rest of his life. I hope God will continue to be with you and the other families as you all go through such difficult times.
