KINSTON, NC (AP) — An off-duty Lenoir County sheriff’s deputy working as a security guard at a restaurant in Kinston has shot and killed a man.

The shooting happened around 3 a.m. Sunday.

The sheriff’s department says Deputy Joseph Heck and another off-duty officer went into the parking lot and saw a man firing a gun at another person. The department says when 26-year-old William C. Gibbs III of Kinston refused to drop the gun, Heck shot him.

Kinston police and the State Bureau of Investigation are investigating.

No other details were provided.

A spokeswoman for Gibbs family said the family did not want to talk about the shooting.
