Man dies during business robbery in Calabash

CALABASH, NC (WWAY) -- A man is dead after an early-morning robbery near Calabash, but the circumstances surrounding his death have investigators working overtime.

Around 5:45 a.m. Brunswick County deputies were dispatched to an armed robbery at Winners World sweepstakes parlor.

According to a police report, two African-American males shown in surveillance video took an undetermined amount of cash before getting away.

Some time during the robbery an unidentified man at the store suffered a heart attack and died.

District Attorney Jon David says his office is investigating to see if there are any legal grounds to pursue murder or manslaughter charges against the robbery suspects.

Any time a death occurs as a result of a felony, even if the criminal did not do anything directly to the victim, is considered a murder according to The Felony Murder Rule. This is North Carolina's current homicide law.

§ 14-17. Murder in the first and second degree defined; punishment.

A murder which shall be perpetrated by means of poison, lying in wait, imprisonment, starving, torture, or by any other kind of willful, deliberate, and premeditated killing, or which shall be committed in the perpetration or attempted perpetration of any arson, rape or a sex offense, robbery, kidnapping, burglary, or other felony committed or attempted with the use of a deadly weapon shall be deemed to be murder in the first degree, a Class A felony, and any person who commits such murder shall be punished with death or imprisonment in the State's prison for life without parole as the court shall determine pursuant to G.S. 15A-2000

Charge them with murder

I don't see why they can't be charged with murder. Someone died while or during the act of robbery. When the cop in Wilmington was chasing that guy on Shipyard get charged for the officer's death? I see no difference. Lock them up and throw away the key. They have no regard for a human's life.

Does anyone know the name of the man who paassed. I work next door to winners world and heard it was one of our customer. It is sad that these scum bags caused an innocent person their life.

...when it come to the forked up court system in place today. Convicted child molesters continue to walk the streets, drunk drivers repeat their crimes constantly and repeat violent offenders walk through the revolving door to carry on with their rampage.
