Man charged with assaulting EMS worker


WILMINGTON, NC (WWAY) -- A Wilmington man is in jail charged with assaulting an EMS worker who was trying to help his girlfriend.

Wilmington Police say they responded to a medical call around 2 a.m. Saturday at 1520 E. Plaza Drive. They say EMS also responded to help a woman, whose boyfriend, Miguel Dukes, was performing CPR on her when police arrived. Investigators say while EMS worked, Dukes became aggressive and combative as they questioned him. Eventually officers took him into custody, WPD spokeswoman Linda Rawley said.

During a search, police found a .38 revolver in a backpack.

Dukes is in jail under $10,000 bond charged with assault on emergency personnel, carrying a concealed weapon and resist/delay/obstruct public officer.

Rawley said his girlfriend was taken to the hospital in critical condition and not breathing on her own. Rawlet did not have information about the woman's condition.

Assault on emergency personnel is a Class I felony.

The woman was a nice lady

The woman was a nice lady who lives just a few doors over from me. She was a loving mother to her children and this did not happen 2 a.m. it was a little after midnight. My prayer and heart goes out to her family.

EMS Worker

So he assaulted a Paramedic while he had a gun with him?? You're dang right this needs to be a felony charge!! Why would you attack/assault a Paramedic in the first place??? Especially one that is there trying to help your girl friend!! Come on people...

Assualting a EMS personell is a Class 1 Felony ,,,,,,,,, Now for the judge to do what is right find this guy guilty and put him in jail for a while

Unless the man waives his right to trial by jury, his conviction or acquittal is determined by said jury. If he has no prior record, he probably won't do any jail time. Assault on emergency personnel is a Class I felony, which is the lowest level within the laws of NC. Under structured sentencing he could only face up to 24 months and that's if he has an extensive criminal history.
