Berger's attorney thinks judge will rule for ousted commissioner


WILMINGTON, NC (WWAY) -- We are one step closer to getting a ruling in Brian Berger's legal battle with New Hanover County.

Both the county's and Berger's attorney, Chris Anglin, submitted their final briefs this week ahead of today's deadline.

Anglin told us today he feels like it's evident Berger did not get a fair amotion hearing, and that Judge James Gale will rule for Berger.

"Any outcome of Judge Gale that gets Berger his seat back is considered acceptable," Anglin said. "Remember: if he remands it back to the county for another hearing, Brian will have his seat back, and we'll get another crack at it. To be honest, no one really knows exactly what will happen until gale rules."

Judge Gale has a month to make his final ruling. Anglin says he expects the judge to decide next week.

The county declined to comment.

were there Ex parte contacts that in the opinion of many were improper, false allegations he knew were untrue or not proven and he should be disbarred for and other wrongful and unlawful conduct- all of which will not go away no matter what the outcome of this amotion hearing. White lied to advance his own interests!
Woody White will be facing serious charges no matter what the decision by Gale. Make no mistake in the opinion of many there have been serious violations of law here in NHC- and they will not be ignored! Berger had health issues- but White and others had legal issues- shame on us for looking other way


If it is sent back to the County then Berger has essentially "won".

At THAT point Woody White and company would have the opportunity to get out of this silliness without having expended millions in taxpayer dollars.
They need to cut and run the first opportunity they get - and if this is sent back, that opportunity would be there.

I think Berger should have resigned a long time ago, but I hope he wins this.


White, Dawson, and Wolfe need to be the ones that resign. They could then start a "reality show" called the Kangaroo Court of New Hanover County.......

Barfield and Berger could pick their replacements, it couldn't get any worse that what these clowns have done.....

I don't disagree with you

I don't disagree with you about the others. They are bad for New Hanover County and I pray that the people in my beloved home town will wake up and start electing people who have their best interest at heart. I think Mr. Berger could have been one of those people, but he has let his personal issues interfere with his duties and became ineffective as a result. I can't say that I know for sure what his issues are, and I don't know if it would be appropriate to speculate in a public forum. But, if it is what I think it is, then he really needs to focus on dealing with it, not doing things that only make it worse.
