WILMINGTON, NC (WWAY) — We are one step closer to getting a ruling in Brian Berger’s legal battle with New Hanover County.

Both the county’s and Berger’s attorney, Chris Anglin, submitted their final briefs this week ahead of today’s deadline.

Anglin told us today he feels like it’s evident Berger did not get a fair amotion hearing, and that Judge James Gale will rule for Berger.

“Any outcome of Judge Gale that gets Berger his seat back is considered acceptable,” Anglin said. “Remember: if he remands it back to the county for another hearing, Brian will have his seat back, and we’ll get another crack at it. To be honest, no one really knows exactly what will happen until gale rules.”

Judge Gale has a month to make his final ruling. Anglin says he expects the judge to decide next week.

The county declined to comment.
