FIRST ON 3: Berger files motion for county to pay legal fees

WILMINGTON, NC (WWAY) — Last week Brian Berger got his seat on the New Hanover County Commission. Now he wants the county to pay for the legal fight.

This afternoon attorney Chris Anglin filed a motion on Berger’s behalf for the county to pay for all of Berger’s legal fees for the amotion hearing and appeal.

In the motion Anglin claims that the county’s action was an abuse of discretion, and that it acted outside of the scope of its legal authority. That’s why he and Berger believe the county should pick up the bill.

“We feel strongly that we put a good case on and that Brian Berger has never been a safety threat,” Anglin said. “He has some personal disagreements with the county and their employees, and I think that he has never been any safety threat.”

Anglin said at this time Berger has not filed a motion to seek back pay for the time he was off of the board, though it is an option going forward.

Anglin went on to say that he and Berger plan on being at the commission agenda briefing Thursday.

New Hanover County Commission Chair Woody White and County Manager Chris Coudriet have not returned our calls for comment.

During the process, the county filed a temporary restraining order against Berger to stop Anglin from collecting more evidence in the case. That motion also asked for Berger to pay for legal fees associated with the motion. While the county was granted the restraining order, the judge denied its request for Berger to pay its attorney costs.

    Woody White and Chris Coudriet will owe us a refund on our hard earned tax money, since WE THE PEOPLE have to pay for THEIR stupid mistakes regarding Brian Berger.

    We will DEMAND that our COUNTY tax dollars, which we paid in good faith to be used in MINDFUL, PROPER distribution of county business be GIVEN BACK TO US.

    Just wait till you see the amount when he sues for damages?! Not only was this whole deal an abuse of power it was also illegal and a civil rights violation against not only BB but the citizens that elected him.
    I’m not pro-BB but it is what it is.

    And why should BB have to pay for the legal bills anyway when it was the board that was in the wrong.

    News flash! WE have already paid for all of the legal fees and research it took to start this mess. They started it and they ought to pay for it themselves!

    If it does come down to B Berger getting his legal fees paid, it should come from those county commissioners that voted for the amotion and used it as a personal vendetta. B Berger is a joke. If he had been left alone, he would have self-imploded. He was a joke when he entered the race and he remains one to this day. But folks were so anxious to “make a change”. You got what you asked for, now everyone will be paying the price. Look before you leap. There is a reason old sayings have been around for so long.

    He is within his rights to ask the losing party to pay the legal fees. Especially when they were trying to abuse their authority by ousting a duly elected member of the commission.

    The ONLY ones I’m aware of that didn’t see this coming was Woody White and 2 other commissioners. They plodded on with their personal vendettas and agendas against the wishes of the citizens of New Hanover County!

    This resulted because of everyone’s desire to get rid of Bill Caster and I’m STILL glad he is out of office. . I think he had a temper tantrum and moved away from New Hanover County after he lost the election.

    Previous polls suggested that many conservatives wanted Brian off the Commission.
    Its interesting to note in the current poll that 50% of respondents believe either the county or the commissioners themselves should pay Brian’s legal fees.
    Perhaps voters have ‘wised up’ to the ways of ‘ol Woodrow. I think that many see this as an underhanded way of doing what voters are supposed to do – get rid of people they consider “bums”.
    Woody underestimated how seriously voters take that “right”.

    There are Abuses of Power in the political arena everyday, but this one was played out in a type of Slow Motion as a further excruciating SLAP in the Face to All Voters and lovers of the Constitution.

    Obviously, WW hid behind female county employees who claimed to be fearful of Brian Berger. Give me a break!

    White and Dawson seem to have issues with free speech- they also have serious issues with the truth. Only threats made by anybody over last few years were those by Woody White, Beth Dawson(and her hubby) and Wanda Copley and a few others.
    White has made allegations that are simply not true.
    Who needs John Edwards, Anthony Weiner, or Bernie Madoff- we have these three stooges. I agree with many others- WHite and Dawson have crossed ethical and maybe even legal limits- lets investigate them- they do far more harm than this guy.

Sit his rear end in the corner and ignore him. Let him draw his check and humiliate himself further. But not one penny for any lawyer bills or costs incurred by him for anything else.
