Berger back in court today, returns to commission tomorrow

WILMINGTON, NC (WWAY) -- Brian Berger made his first public appearance Wednesday since learning last week he will return to the New Hanover County Commission.

"I am trying to be different and am doing the best job I can to keep the promises that I made when I ran and I am going to continue to do that," Berger said. "What the rest of the board does, you have to ask them."

His return to the spotlight was in New Hanover County Court for a DWI charge from December. He'll have to wait until at least this December to go to trial.

"It is going to be done before the year anniversary," District Attorney Ben David said.

David says the case was continued so an outside judge can hear it and so out-of-town witnesses can testify, including the WPD officer who made the stop and now lives in New Jersey. Prosecutors also want to see if SBI tests on Berger's blood find anything other than alcohol in his system.

Thursday Berger rejoins the commission. As he left court, we asked Berger how he thought his return will go.

"I think you would have to ask (the other commissioners) how they plan on treating me," Berger said. "I hope they will professional and collegial and amicable."

Berger was adamant that once he is back in his seat, he will focus on issues he campaigned on.

And as Berger prepares to face his fellow commissioners publicly for the first time since his amotion hearing, he says he is ready and not nervous at all.

Commissioners meet for an agenda briefing tomorrow at 4 p.m. We'll have an update on WWAY NewsChannel 3 starting at 5 p.m.

Here we need to have a NJ resident travel here to testify. Will he? And who will pay?
How badly does LE want to punish Berger and who is behind it?
For MOST cases like this the charge would be dismissed if the arresting officer does not show.
The Berger saga, although brought on by Brian himself, is looking more and more like a vendetta. Berger is complete idiot - and we put him in office. WE Should take him out of office.
This is almost like Weiner and Spitzer in New York. They have learned that voters are not as forgiving as they had hoped. Brian is going to find that out too.
But many people are beginning to see that Woody White and crew, in their attempt to unseat Brian, have gone too far and they appear to be wanting to control the destiny of an elected board, rather than letting US decide. That is giving them a reputation of being power hungry, over bearing politicians. This is almost as bad as Brian's reputation for being an idiot.
This could cause a huge turnover on the Commission and I welcome that. I wish the Wilmington City government turnover could happen as well......

Berger blew a 0.08 - he was right at the limit.
His case has been continued 4 times.
Now, think about the amotion process to remove him from elected office.
Costing his his job, pitting election law against common law - in a case that could/should end up before the NC Supreme Court.
How many times can he continue THAT case? When he got 4 continuances for blowing a 0.08?
Hello? Is there anyone home in Woody Whites head ?
Brian could continue this well past the time when we the voters toss him out.

How long is the term length for County Commissioners? Regardless of whose side anyone is on, it just seems to be ridiculous that this takes up as much of the County's energy as it does.
Has he been re-elected during the course of this embarrassing episode?

Really? I dislike Brian Berger - he's an embarrassment to the county and to himself. I don't care about his domestic issues with ex girlfriends. I do care about DUI charges, lateness to meetings etc.
But answer a question. IF this were Woody White, a Republican would we have the same issue? Would people supporting Woody be just a stupid as he is?
I DO have issues with Brian and regret voting for him - but I have an equally important concern when another politician tries to render my responsibility to vote as impotent.
It's like saying "Hey Vog, we know you made a mistake, but we'll fix it for you."
Sorry - when it comes to voting I will correct my own errors thank you very much - and anyone who tries to fix if for me is losing my support. White, and Dawson will NEVER get my support again - for any office they seek. Nor will Brian Berger.

It would be proper to say "created". They've hated Berger ever since he won the election. Bully Boy Thompson never, ever gave him a break. Ted Davis publicly humiliated him at every opportunity (and wasted NHC commission meeting time) and the others have taken their "pot-shots" as well. They've wasted taxpayer money, energy and valuable public meeting time to beat this man to a pulp and laugh about it.

I've never agreed that Berger hasn't made some mistakes, but most of those have to do with his personal life that the other commissioners unfairly exploited with their easily available public venue. Sure he was late for meetings, big deal. They've bullied him, pointed fingers at him and pushed him around as a pack of rabid dogs from day one. It was never a fair deal and Berger was never prepared for their putrid and obvious display of hatred against him.

What goes around, comes around! I've always hated bullies and I've hated "group bullies" (aka CLICS) even worse. The commissioners of this county should be ashamed of their childish and incessant badgering. I hope each and every one of them gets sent packing their desks at the next election! This county is an important county to this great state and the simple, basic fact is that WE simply deserve better! WE...will get it!!! The power is in the people, not in the hands of these imbecilic and temporary representatives that waste our money, can't focus on the REAL issues and have done nothing productive during their terms in office as NHC commissioners! Where I come, from that's termed as getting a big "F" while in college, a big "FIRED" while working for a corporation and a big "FAILURE" as a politician! There are more "F" words deserved and we all know what they are.

Why is this clown allowed to keep postponing his court case for DWI?

The officials are waiting on

The officials are waiting on results from blood tests. The prosecution's witness wasn't available, for whatever reason. So, the indicators point to the District Attorney wanting a continuance.

Because the arresting officer now lives in New Jersey and did not show up for court. Any other case would have been dismissed, and their are plenty that have been when the arresting officer did not show......but in this county's zeal to crush Brian Berger, he doesn't even get the breaks other people get. If the county pays for this officer to come to testify, they should have to prove that they pay for all of the officers that no longer live in this area to come back and testify.....otherwise the witch hunt continues........

One other point, I believe that most DWI cases that have a lawyer involved take about a year to be heard.
