WILMINGTON, NC (WWAY) — A Wilmington man is in custody after he pointed a pellet gun at a Wilmington Police Officer.

Around 1:30 pm this afternoon an officer was on patrol behind Kmart on South College Road when 48 year old Warren Taylor Small approached the officer with a black handgun.

The officer tried to get Small to lower his weapon with a series of verbal warnings but the man refused.

After Small repeatedly failed to comply the officer fired one shot at Small missing him.

When police arrested Small they discovered the handgun he was carrying was an unloaded pellet gun. Officers say he was also extremely intoxicated.

At this time Small is in the New Hanover County Jail facing charges of assault by pointing a gun and going armed to the terror of the public. Bail has not been set at this time.

The officer involved in the shooting is on paid administrative leave pending the outcome of the investigation.
