WILMINGTON, NC (WWAY) — A judge has issued a warrant for Brian Berger’s arrest after the New Hanover County Commissioner failed to show up for a court appearance. But Berger tells WWAY he did not know he was supposed to be in court.

Berger was due in court this morning for charges of drug possession, DWI and impeding traffic. The charges stem from Berger’s arrest Dec. 6 after Wilmington Police say they found him slumped over the steering wheel of a car on Masonboro Loop Road.

When Berger did not appear today, Judge Sandra Ray issued an arrest warrant with a $25,000 bond, according to the District Attorney’s Office.

When reached via text message this afternoon, Berger told WWAY he did not know there was a warrant out for his arrest and that he was not in town.

“I was scheduled for court jan (sic) 16, jan 29 and feb 20,” Berger wrote. “I was there the 16th. No notice of a change in schedule was provided. I’m sick of all the dishonesty and evil. I offered to turn myself in to authorities and received no response from my attorney, woody white’s (sic) buddy. I have the text message(s) to prove it.”

But when Berger’s court date was continued last week, WWAY and other news outlets reported that the case was rescheduled until today, and the case was on an online docket. Berger is due back in court Jan. 29 for a trial on his Dec. 2012 DWI arrest.

Berger’s attorney Buddy Allard could not be reached this afternoon for comment.

Has now outdone Woody as “Commission Clown” of the year.
But it is up to US to remove him, not Woody White.

Let’s remember his attendance record as a Commissioner. How many times was he absent? How many times did he use the excuse that no one told him about the meeting? Same Brian, different day.

Uhhhh why would Berger be in NY if he had a court date, Probably never left Wilmington. He thinks he is Steven Segal “Above The Law”.
Could you imagine being his neighbor,,, just saying,

Gee! He must not watch the news or read the papers..his court date has been the front story for the past day! Maybe he was too busy stalking his ex, feigning suicide or passed da eff out in a turn lane. #KeepMakingWilmingtonJoke
