RALEIGH, NC (AP) -- The state Court of Appeals is ordering a third trial for a Raleigh man convicted of killing his pregnant wife, saying the judge shouldn't have allowed evidence about a wrongful death lawsuit and a custody challenge for his daughter.
The court ordered the new trial Tuesday for 39-year-old Jason Young, who's serving a life sentence for the murder of his wife, Michelle. She was five months' pregnant when her sister found her body Nov. 3, 2006, in pool of blood in the Youngs' bedroom. Their then 2-year-old daughter also was in the bedroom.
Young was convicted in March 2012 after the jury in an earlier trial deadlocked.
Jason Young has maintained he was in Virginia when his wife was killed. He has said he wasn't involved in her death.
