WILMINGTON -- We have some long-awaited answers in the Phillipe McIver case. The State Bureau of Investigation has done its work and District Attorney Ben David says no criminal charges will be filed against the officers involved in the shooting. The DA says the officers involved in the death have been cleared by the SBI. He says while the incident is tragic, officers did not use unnecessary force. This decision came after carefully reviewing video tape, witness testimony and physical evidence. According to the DA that evidence is consistent with the accounts provided by the officers. David says the SBI investigation revealed that gun powder residue was found on McIver's hands and that McIver fired twice at an officer after removing his gun from his holster. The investigation showed his partner fired several times at McIver, killing him. David says those actions were necessary to protecting his partner's life and consistent with his training. The victim's mother Phylicia was at the press conference along with they both say the findings will allow them to get some closure. The victim's family requested the videotape and pictures not to be released. David also said McIver's toxicology report is not back, but the results of those tests will not change his ruling.
