A suspect in a sexual assault case from five years ago is in court today. A random hit in the national DNA database linked Troy D. Simmons to an alleged sexual assault in May of 2002.
The alleged victim says she left a restaurant after having a few beers, then got in a cab and went to a friend’s apartment.
That is where the alleged crime took place. The victim says Simmons got inside the apartment, held a knife to her throat and forced her to give him oral sex.
In a New Hanover County courtroom on Thursday, the alleged victim had an emotional breakdown and the defense attorney asked for a mistrial.
Judge Kenneth Crow denied that request and told the jurors to ignore her outburst.
The defense then continued it's questioning and focusing on the cab driver, and his whereabouts during the crime.
The trial is expected to continue Friday.
Troy Simmons was already in state prison serving a 14-year sentence for rape in Onslow County when authorities linked him to this crime.
