I can't see how the dealership thinks this isn't their fault. She paid the dealership the money. If an employee stole it after that, it's their problem. This dealership is going to regret their decision not to refund the money when the lawyers get done with them. Not to mention the bad word of mouth, which in this town, can be lethal.
