NC trial for nursing home shootings won't move

CARTHAGE, NC (AP) -- The North Carolina man accused of killing eight people in a nursing home shooting rampage last year will go on trial in the county where the deaths occurred.

The Fayetteville Observer reported Friday the death-penalty trial for Robert Stewart will stay in Moore County, but jurors will be brought in from elsewhere. Defense attorneys argued Stewart couldn't get a fair trial in the county shaken by the killings at Pinelake Health and Rehab Center.

Judge James Webb also ruled Thursday that prosecution experts can evaluate Stewart's mental health. The judge said Stewart should be held at the local jail instead of a state prison where his housing and medical fees have cost the county $54,000.
