...as nothing in my post is "...absolving myself of all liability...". It is about those that are at a severe disadvantage in the categories of mass, velocity and the inability to make rational decisions for their personal safety on public roadways...in the middle of the night...in the dark...with dark attire and even possibly intoxicated or with mental impairment.

I'll put his very simply for you. IF you have the mental capacity, get out and stay out of harms way. You aren't going to win against an automobile, no matter how "right" you are.
