They provided a rental car which indicates Mr. Berger had insurance and the Insurance Company agreed he was the cause of the loss.
Now the issue is whether they pay to repair her car OR find the cost to repair exceeds the total value of the car in which case they will pay it as a total loss. No insurance compny is going to pay more than a vehicle's worth to repir it.
All a question of numbers
