No charges filed in strangulation death

NEW HANOVER COUNTY -- The New Hanover County Sheriff's Department is investigating a strangling death in Castle Hayne.

It happened around 9:30 Wednesday night, and the 911 tapes tell how it all unfolded.

OPERATOR: "New Hanover County 911, what is the location of your emergency?

We need a sheriff's deputy out here immediately. 107 Fairford Road. We need him immediately.

What's going on?

My ex-boyfriend is trying to beat me up and now he's going after my son. My sons got him held down to the floor. We need someone here now, right now."
The woman on the phone is Anita Brown, calling from her home on Fairford Road in New Hanover County. The man who she says is attacking her and her son, is 47-year-old Dennis Marvin Capps. Family friends also called 911 for help:
CALLER: I just left my friend's house, his mom's boyfriend is in there drunk raising hell.

This guy's acting crazy here, and we're fighting, trying to keep him down.

It took deputies several minutes to respond and from the sound of the 911 tape, Capps had stopped breathing by the time they arrived. He was pronounced dead at the scene.

Sheriff's investigators say the case is still under investigation. No charges have been filed so far.
