RALEIGH, NC (AP) -- A former Duke University student is suing the school over what she calls hostile treatment after she was raped at a fraternity party.
The lawsuit was filed in federal court and claims she was tricked into leaving the school after the 2007 rape.
Michael Jermaine Burch pleaded guilty in the rape case in 2009 and is currently in state prison.
The woman blames comments to the media by Duke vice president Larry Moneta for creating a hostile environment for her on campus.
Duke denies the claims and says she withdrew voluntarily. The school also says the case falls outside the statute of limitations and should be dismissed.
Calls to lawyers for both sides were not immediately returned Thursday. The Associated Press generally does not name victims of sexual assault.
