WILMINGTON, NC (WWAY) -- New Hanover County Commissioner Brian Berger has been laying low. Other than appealing his violation of a protective order, Berger has been out of the news, until he sent an email to fellow commissioners around 2:40 a.m. The email expressed Berger's disapproval of the board sending a letter of support for a head start grant.

Wednesday morning New Hanover County Commissioners woke up to another email from Berger filled with accusations of corruption and a lack of transparency.

Berger was responding to a request from New Hanover County Schools for a letter of support for a HeadStart grant. The school district is taking over the program after the federal government stripped it from New Hanover County Community Action because of management issues.

Berger did not seem to understand that, though, and accused fellow commissioners of making fraud and the endangerment of children "more accepted and fraud and abuse more insignificant in more areas."

Commissioner Jason Thompson provided the clarification Berger needed, but he told us he's tired of berger's accusations, especially when he does not understand a situation.

We asked Berger about the late night email while he was on his way to court Wednesday in Brunswick County, especially about his accusations about corruption and transparency.

"That was not intended to be the implication," Berger said, "and the email was not meant to be adversarial."

Berger's lawyer, Thom Goolsby, then ushered him into the courtroom, where he is appealing a protective order violation. A judge said Berger violated the order when he went to a meeting at New Hanover County Community Action, where his ex-girlfriend works. That appeal moved to brunswick county because of a change of venue request. Jury selection and opening statements began today.
