RALEIGH, NC (AP) -- A North Carolina state trooper fired in 2003 for having extramarital sex in his patrol cruiser will not get his job back. The North Carolina Supreme Court has denied Monty Poarch's request for a discretionary review. That effectively ends the former trooper's long legal fight to obtain reinstatement. The high court's decision follows the October ruling of a three-judge panel at the Court of Appeals to uphold a lower court's ruling sustaining the state's decision to fire Poarch. The patrol's investigation determined Poarch had sex with his mistress while on duty in his state car and at a patrol office. Poarch is currently employed as a captain with the Caldwell County Sheriff's Office. He did not immediately respond to a message seeking comment. (Copyright 2012 The Associated Press.
