Meets all of the elements of protection under castle doctrine shooting. Sad it's his brother, but this is exactly what every person, especially awakened in the middle of the night by an intruder at their home legally need to do to protect themselves. Turning on lights before shooting only gives the intruder a better advantage of seeing you.
