The littering law is MUCH harder to enforce for smoking. Do you put the butt in your empty beer can? Not littering if you put the can in the trash receptacle. Take that butt and bury it in the sand and it IS littering but that action takes less than a second.
Smoking provides a clear "visual" and an odor which is why they went to anti-smoking versus littering laws. IT makes it easier for an LEO to enforce.
Remember it's all about making a cop's job easier so as to increase the town's revenues - just like parking meters.
