Kudos for using a shotgun, but why would anyone think that birdshot is an effective anti-personnel round? If the suspect was fleeing, the neighbor had no justification for firing. (That's according to state law - if it was up to me, blast away!) If he ever finds himself in another situation wherein he needs to use that shotgun against some dirtbag, tell him to spring for a box of #4 buckshot.
