Taking their car is too much

You'd run into Fifth Amendment issues since DWI is a misdemeanor. This is a simpler approach: 1st offense: $5k fine, twelve consecutive weekends in jail, restricted license only available to those with a job and who pay to have the breathalyzer ignition cutout installed. 2nd offense: $10k fine, ninety days in jail, no restricted license available at all, license supended for one full year. 3rd offense: (Felony) one year in prison, $25k fine, licence permanently revoked for life. (The courts might go for forfeititure of vehicle at this point.) Caught driving after that? Five years in prison. Caught driving drunk? Ten years in prison.
