How far can you go to protect your home?

The shooting of a man allegedly trespassing on Sen. R.C. Soles' property has led to a lot of questions regarding what the law allows when it comes to shooting someone on your property. According to the North Carolina Justice Academy: "North Carolina law does allow the use of deadly force against an intruder to prevent forcible entry into the home or residence, if the occupant reasonably apprehends that the intruder may kill or inflict serious bodily harm to the occupant. The law does not permit the use of deadly force solely to protect property, or to prevent theft. If only property is threatened, deadly force cannot be used. If entry can be prevented by non-deadly means, the use of deadly force would not be necessary."

self preservation and protection

We the people have the right of self defense. However in this case I believe there was no longer a threat. We will see what money and connections will buy you over the next few weeks wont we.

It's Simple for me

It's very simple for me. someone enters my home, or my garage for that matter...he will get one get one warning...and that will be the sound of my large dogs barking. They won't hear the second sound that will come from either my .45 or my shotgun.

All of you cowboys out there can shoot all you want, just remember there'll be a liberal judge and jury there in the end to slam and condemn your actions. You should be willing to share your things with those that are "less fortunate" anyway. What's the difference between a thief breaking in my house then stealing my things and the government stealing my hard earned money and giving it to non workers? The Castle Doctrine bill

The castle doctrine bill is a bill that a man's home is his castle and he has the legal right to defend it using deadly force if necessary. The Florida "Castle Doctrine" law basically does three things: One: It establishes, in law, the presumption that a criminal who forcibly enters or intrudes into your home or occupied vehicle is there to cause death or great bodily harm, therefore a person may use any manner of force, including deadly force, against that person. Two: It removes the "duty to retreat" if you are attacked in any place you have a right to be. You no longer have to turn your back on a criminal and try to run when attacked. Instead, you may stand your ground and fight back, meeting force with force, including deadly force, if you reasonably believe it is necessary to prevent death or great bodily harm to yourself or others. [This is an American right repeatedly recognized in Supreme Court gun cases.] Three: It provides that persons using force authorized by law shall not be prosecuted for using such force. It also prohibits criminals and their families from suing victims for injuring or killing the criminals who have attacked them. It has been passed in several states, and now in north carolina it's being held up in commitee by a democrat. No doubt the bill will never see the light of day because the right to protect your home and body is something democrats don't want. Unless your RC Soles.

You are missing the point

The Senator shot the party in the back of his leg outside his home while the the burgler was leaving. accordingly he was no longer a threat, so the senator should be charged with shooting the burgler and unlawful discharge of a fire arm. Also, I want to know why, if the senator's property is located outside the city limits of Tabor City, (for tax reasons I am sure) then why are Tabor City police responding. Should be Coulmbus County Sheriff's office. I know they only have 5 road deputies, however, Senator Soles should have to pay for his calls since he keeps such company.

Most of the comments shown here are valid - except in this case Mr. Soles knew the person standing at his door - it was a client for crying out loud; it was broad daylight; and from the accounts he wasn't trying to break in, he was knocking loudly on the door - therefore it appears Mr. Soles violated NC law. And, I don't believe a shotgun is covered by a concealed weapon permit. It should be fairly easy to verify with the hospital whether the wound was to the front or the back of his client's leg and were they shotgun pellets or a bullet.

According to my concealed carry instructor, if the intruder is still outside, attempting to break in, you can assume that he is armed and if you fear for your life, shoot him through the door. If he is already inside, if he has a weapon or you have reason to believe he does, the same rule applies.

Nowhere, however, does it state...

...that you can exit your house to face down the guy and then shoot him, as Sole's own attorney states he did.

can assure you...that if an intruder is in my home...my first and only thought is that they are there to do me or my family harm....PERIOD.

Rape? Steal? Or Murder?

So when someone comes busting in a door, or crawling through a window, we should yell out and ask the intruder what their intentions are?? Homeowner, "Sir, do you intend to just steal a tv, or are you going to rape and murder? Depending on how you reply, I may shoot you dead." No homeowner should have to try and access the potential danger to a home invasion....there isn't time and your families life depends on quick action.

I can tell you this. I would rather be judged by twelve, then be carried by six!! If you know what I mean. If someone comes in your house, all bets are off. You need to protect your family and yourself!! PERIOD!!!!!
