LELAND -- A Leland man is upset with a local pool company. Don Ruttan paid Tarheel Pools and Spas thousands of dollars to install his pool last year. Now, he's having problems, and says he can't get the company to do anything about it. It was a big investment for Ruttan. A pool in his yard was something to enjoy with his wife and grandkids. He just bought the pool last year, but something went wrong while it was covered up for the winter. Ruttan said, "In the early spring of this year I went out to open it up, and found out the water was gone." The pool had a leak. It appears the liner was faulty. So, Ruttan called Tarheel Pools and Apas, the Wilmington company he bought it from. "All I would get is the answering machine, the answering machine, and I called every day, seven days a week for a long time, and then finally I went up there," Ruttan said. When Mr. Ruttan finally did get to talk to someone, they weren't much help. The owner, Kevin O'Donovan Sr. says his son Kevin Jr. is the one who installed the pool. Kevin Jr. has apparently left the business and Kevin Sr. says he's not responsible for his son's customers. He says they were doing business separately under the same roof. Bt Mr. Ruttan's invoice clearly states Tarheel Pools and Spas at the top, and attorneys we spoke to think the Market Street company has an obligation to help. Attorney Chris Chleborowicz said, "There is some leverage that can be put on them, one of which is the Better Business Bureau, the other is just the threat that there was some bait and switch, where they thought they were getting something and they weren't and that can have some pretty substantial and severe legal ramifications for the company." Mr. Ruttan found out a little too late that Tarheel Pools and Spas is already on the Better Business Bureau's radar. The company has an unsatisfactory record for failure to respond to customer complaints. Mr. Ruttan wisely kept all of his paperwork. Because of that he was able to get some help through the manufacturer's warranty. The company that made the pool liner has shipped him a new one. But Ruttan had to install it himself since Tarheel Pools and Spas refused to help.
