Critics of North Carolina hate crime laws made their voices heard outside of the New Hanover County Court House Thursday. Hate crime laws in North Carolina upgrade misdemeanors to felonies, but some groups feel the law neglects some often targeted members of the community. In mid-July, two men were attacked while leaving a bar in downtown Wilmington. They say the attack took place because of their sexual orientation. “In downtown there is a lot of general violence, but this violence by three assailants was directed towards these two men because of the perception that they were gay,” said Tab Ballis, who is promoting hate crime awareness. North Carolina laws protect against discrimination for race, religion, or country of origin by classifying them as hate crimes, which carry stiffer penalties. Assistant district attorney James Blanton said, “Sexual orientation is not one of the protected classes. If someone commits a misdemeanor assault based on the fact that the victim has a different sexual orientation that they're not satisfied with, it would not bump it up to a felony.” Thursday community supporters raised their signs calling for that to change. The North Carolina General Assembly is considering Bill 207 which would broaden the definition of hate crimes. “It helps to have our gay community supported, adding not only sexual orientation, but gender and disability as well,” said Ryan Burris. Supporters believe the Safer Communities Act would provide more security for the lesbian, gay, bisexual and transgender community. Burris said, “I definitely think it would help to deter people from targeting a specific demographic as the gay community.” “Hate crimes are based on fear, ignorance, and misunderstanding. And I think we all believe that folks that pay taxes deserve to be safe in their own community,” added Ballis. Thirty-three states recognize violent crimes associated with a victim’s sexual orientation as hate crimes. If legislatures approve Bill 207, North Carolina would be added to that list.

This example will surface eventually, with all H*LL to pay: With companies that will insure an employees partner, a "same sex partner", but "WILL NOT" insure an (i.e.) employees partner of the opposite sex living with them, a descrimination law suit will reach the Supreme Court levels with companies paying out huge fines practicing this form of gender descrimination. Why it hasn't yet is beyond me, and everyone else to if you would just stop and think about it.

thought punishers

hate crimes punish thought, its really very simple. If a crime is committed, you punish the offender to the fullest extent of the law. If society starts punishing people because of what they think they are thinking, wow what a slippery slope....where do the thought police stop?

Just Listen

Gay people don't choose to be gay. Who would want to be gay in this day and age? The gay community is discriminated against because of the people they choose to love. They lose jobs, get made fun of in school, get harassed, get beat up, are disowned by family members, and kicked out of religious places. If I could, I wouldn't be gay. But I am. Its too tough sometimes. I wish I was straight some days but then I look at all my wonderful friends. We created a support system for each other and everyday I am reminded of that simple factor. I am loved by them no matter what sexual orientation is but there are many of my friends, especially teachers that are not out. If they were out they would lose their jobs. In time our grandchildren will look at this time and we will be embarrassed because gay people are being harassed, beat up and lose jobs due to their sexual orientation....its why so many are in the closet...because they fear what could happen. Gay people should have special rights if they are being targeted for their sexual orientation. Hopefully in time the law will become unneccessary but until gay people feel as safe as straight people walking down the street, don't you think they should be more protected. Thanks

In time? Those are the words of an optimist. In time it is more likely to get worse. Gay people will never feel as safe walking down a street as a straight couple would.

Your comment is a bunch of rubbish. You choose to be gay just like whenever you got dressed this morning, you chose the clothes to put on. Gays don't deserve any special rights. Get over it. You're not special. You're just practicing sin. The devil has you so fooled. You need to seek the Lord's help. Should all people who have problems be given special treatment? For example, obese people? People with a speech impediment? The answer is no. God did not make you gay. You chose to be the way you are.

Gay people should have special rights....? It's truly amazing how any marginalized/minority group shoots themselves in the foot and alienates people who have previously supported them by going overboard and making ridiculous demands. I was politically active in the civil rights movement, but my interest waned when Affirmative Action arrived, as it represented exactly what we were trying to undo in this country: Racial privilege. When I heard about "reparations," I told my Black friends they were on their own. I used to give thousands of dollars every year to a charity that helped the Navajo people on their reservation. Then the Navajo filed suit against the tobacco companies and not wanting to offend them, my charity was directed elsewhere. A lot of that money came from tobacco. Anyone who has read my posts knows that I support total equality for gays and Lesbians. I want the govenment out of the marriage game altogether, registering only domestic couplings, heterosexual and homosexual alike. (A man and a woman get "married" in a church or synagogue.) Your post however, is clearly indicative that once again, my interest in what happens to people outside my demographic group is likely misplaced. Your post should be entitled "How to Alienate Your Supporters 101." First make all the demands you wish regarding equal right from the government as that is your right, but do not be so presumptuous as to expect religions to alter their views based upon political correctness. The Bible (both New and Old Testaments), Koran, and Talmudic Law are all quite clear in their judgement of homosexuality. Second, you will note that I said to speak up regarding your demand for EQUAL rights. Get this though your head - your sexual preference does not entitle you to special rights! Your life is no more valuable than mine. If someone assaults me, it is just as serious a crime as if someone assaults you. There are laws in place to demand justice for BOTH of us. If you're gay than be proud of who and what you are. Stop the snivelling about "Golly gee, I wish I was straight," get out there and bust your butt insuring that you have the same rights as I, but don't expect God to be politically correct or to obtain "endangered species" status from the government.

ok maybe i'm not getting this but why don't we just make it a felony to assault everyone. saying a crime is worse because of the reason it was committed is pointless and a waste of government resources. if this bill passes i would be able to hit a Caucasian male of roughly 150 lbs who doesn't have a religion and it will be a misdemeanor hate crime is just another way for people to prove that equality is a joke and no one could stand to be "equal" because that would take away their right to special treatment.

What is a Hate Crime?

I looked on the FBI' website for information. Here's the url: http://www.fbi.gov/ucr/hc2007/index.html and an exerpt: "The FBI’s Uniform Crime Reporting (UCR) Program collects data regarding criminal offenses that are motivated, in whole or in part, by the offender’s bias against a race, religion, sexual orientation, ethnicity/national origin, or disability and are committed against persons, property, or society." It Does say sexual orientation.

Hate is ignorance. Sometimes it is one's own confusion about one's own orientation that creates hate on this level. There are sick people out there who will use violence on other's just because of this and they MUST be held accountable! Great stuff! I applaud your efforts!

I feel that everyone has a right to there own way of life but when you choose to be gay and you choose to live that kind of life then you have to know that there will be things that are said and done from people that dont approve of your lifestyle. And even if a law was put on the books protecting gays, how would you ever prove they were attacked because they were gay? Leave the laws like they are and prosecute someone because they attack an individual, who cares why. That's called assault and its already a law.

Am I the only gay person that does not believe in hate crime legislation? A crime is a crime - the motive behind it doesn't matter. You cannot and should not punish people for what they believe. The day we begin to punish people for their personal beliefs is the day western society officially begins to fail.

I feel the same way. Harsher punishments all around, I don't want to be singled out for "hate crime" laws that essentially try to govern how people think. Anti-discrimination laws i'm all for but these are just redundant and silly.

Gay Hate Bill

People---get over yourselves. You are HUMAN first, and crimes against HUMANS must all be taken seriously. These hate crime bills make no sense. Anyone can be charges with a hate crime now----unless you stick to black-on-black violence and white-on-white violence. A law breaker is a law breaker. We shouldn't be looking at the color of the skin of the law breaker or his/her sexual orientation to determine the punishment they recieve.

You can make up all of the laws you want to and pass them into force by the basketload, but it will not change the way people think. Humans are humans and that's what the current and enforceable laws cover. New laws will make no difference. The majority of people still disagree with the gay lifestyle and that's just a simple fact. Perhaps if the gay community would stop shoving in in everyone's face to say, "Look at me, I'm GAY!" no one would even notice and leave them alone, that's the overall goal, right? What a load of bovine droppings

The attackers who assaulted the two men already broke several laws. We don't need a new law. Enforce the ones already on the books, and stop trying to give "special status" to people because of their sexual preferences.

Please tell me that I am qualified to have those attacking me be charged with a hate crime. You see, I am a working man. I've done it all on my own, started with nothing. But there are people who want I have earned that have not worked. Could this be construed as being a hate crime? If so, let's deport them to Cuba or Venezuela where they can have a better life.

My father Kenneth R. Durham

My father Kenneth R. Durham was assulted the early morning of july 3rd, 2001 after coming out of gay bar downtown. He later died on the 12th. I never got to tell him goodbye. His murder is still unsolved. He died from a brain anurism caused by a blow to the head. He was killed because of someones hatred toward gays. Hate crimes hurt victims and families just like any other crime.I believe a persons sexual orientation is their right and that right should be propected under the law.

...won't be charged with murder or manslaughter? Gay people aren't protected under current law? We need new laws, so we can....what....add additional punishment because they're somehow sacred? Let me put it to you very simply: Your father's murderer deserves no greater punishment than the person who kills any straight person. The people who assaulted those two men in downtown deserve no more punishment than they would receive for assaulting any two straight men. To argue that an assailant who attacks a gay or Lesbian should be punished more severely than if that person attacked a heterosexual is a blatant attempt to establish gays and Lesbians as receiving greater importance and protection than straights. I'd suggest that you read the Fourteenth Amendment, guaranteeing "the equal protection of the laws."
