State: Man shot in patrol car had not been cuffed

MARION, N.C. -- A report says a man shot to death by a state trooper in his patrol car after the man attacked the officer with a box cutter had been searched but had not been handcuffed because he was not under arrest. The North Carolina Medical Examiner's Office says 32-year-old Daniel Boyd Cole Jr. was killed by a single gunshot wound to the chest March 14 in McDowell County. The report says Trooper Andy Waycaster shot Cole in the car on an Interstate 40 overpass. Highway Patrol Lt. Everett Clendinin told the Asheville Citizens-Times for a story Tuesday that Waycaster has returned to duty, although he suffered extensive injuries to his face and arms. Clendinin says an internal investigation by the patrol cleared Waycaster. The State Bureau of Investigation is still investigating.
