WILMINGTON, NC (WWAY) — An Apex man and a Wrightsville Beach man face assault charges after allegedly attacking an off-duty cop. It happened over the weekend at a downtown Wilmington bar.

Surveillance footage from a bar on Front Street in downtown Wilmington shows two men whispering to one another. Less than a minute later one of the men slaps off-duty Wilmington Police Sgt. Curt Stansbury in the back and then gets in his face the other man gets up from his stool.

Stansbury and one of the men chat for about 45 seconds and then without any warning, Stansbury is sucker-punched by the larger guy. The off-duty officer appears to be knocked out as he hits the floor. Bar patrons quickly get the men off Stansbury and help the cop up. Stansbury later talks with an alcoholic beverage control officer about his run-in with the cheap-shot duo.

Though not arrested that day, a magistrate issued warrants for the two men, Robert Bogen, 56, of Wrightsville Beach. and Marc Ingham, 44, of Apex.

Ingham, who is seen in the video punching Stansbury, is charged with assault and battery and misdemeanor conspiracy. Bogen is charged with simple assault and misdemeanor conspiracy. Both men have been served and are out on bail.

As for Sgt. Stansbury, he is saying very little at this time. But in an email he said, “I am recovering the best I can.” The police department says due to his injury, Sgt. Stansbury has not been able to return to work.

We also spoke to Ingham’s attorney, who declined to comment, even when we asked if his client was provoked.

This is not the first time either suspect has been in trouble with the law. Last year Bogen was charged with assault with a deadly weapon. In 1997 Ingham was charged with simple assault. Both men are scheduled for court in January.

Its been said a thousand times you shove this 20 year olds in a hot club and pump them full of alcohol and this will….oh wait what? It was not a club nor was it 20 something’s, but “grown men”? Can’t be…

  • Guestwhat says:

See…Once these middle aged and senior citizen guys start showing up at the party you know there going to be trouble.

  • Guest123456789 says:

I agree, it doesn’t make sense. Something must have precipitated the incident. Oh and don’t tell me everybody is wonderful, if you put alcohol in a person, sometimes wonderful, can become a total jackass pretty quickly.

Love the camera, perfect position! Wonder if the video cameras captured any of the events leading up to the incident?

  • GuestPF9 says:

Don’t blame them for getting one side, they tried…

“We also spoke to Ingham’s attorney, who declined to comment, even when we asked if his client was provoked.”

His attorney knows his cliet messed up.

There is more than one side to the story. The word on the street is, the “victim” said some unsolicitted, pretty nasty stuff to one of the women with their party. I heard her called her a “f###in crackwhore”. I also heard he was so trashed he could barely stand up. Wilmington’s Finest?

Not saying that this deserves a punch in the head, but there is always more to it than what the cops have to say, especially when the “victim” is a cop.

Ask yourself: does it really make sense that these two guys just decided to jump some guy for no reason?

  • Joe Blow says:

So someone has ordained you with the knowledge that these two men you don’t know are “cowards?” And “cowards” belong behind bars? Why can’t clowns like you WAIT until ALL of the FACTS to come out, before you open your traps? Remember the old adage: “Better to remain silent and be thought a fool than to speak out and remove all doubt.”

  • PublicAvenger says:

Bring it to court. Please tell the JUDGE what ANYONE could possibably SAY to make it LEGAL for TWO loser cowards, to hit a man from behind. This coward would’ve run, if it was him alone, face to face with Sgt Stansbury.

Cowards like this belong behind bars. How many times has this bully-coward not been photographed, nor arrested ?

Something is interesting about this. The Lumina News reported as follows: “Dec 30, 2010 – 26, as Robert William Bogen Jr., 56, of Wrightsville Beach, was charged with assault with a deadly weapon and carrying a weapon into an …”

As of this morning, the link to this article is not working…

  • Brian says:

Because Lumina News wants to make as interesting as they can. Fact or not ? Twist it best way they can !

  • Brian says:

Take it to the octagon you bad asses! I bet he will think twice about calling someone’s girl a crack whore ? Being a cop or an lawyer has nothing to do w/ it !

  • William says:

You better be glad you got your sucker punch in boys because if Stansbury would have thought for a minute that you were going to attack him, you both would have had a bad night.

  • BigAlTheTerp says:

Just being punny, but the headline could also lead one to believe the police officer should have ordered Jagermesiter or Patron instead of the cheap well stuff. Okay, back to work…

  • joe says:

Let me just say its close minded individuals such as yourself that think that just because someone has made a mistake or broke the “law” in the past, That they will always be a “criminal” !!!! Not always the case buddy. And on another note, Just because you have known someone for “years” doesn’t mean you really know them. Alcohol can turn the best of gentlemen into the worst people. When abused.

  • Gramps1935 says:

It takes a real coward to double team and sucker punch another man. I’ve known Sgt Stansbury for years, he’s a good guy. I hope these two guys pay up. Its always the cowards that double up, them bully another person. If these guys have been arrested in the past, it means they have probably abused many people many times. Only a small percent of these assaults result in arrest.

  • Guest121212 says:

Whats up with these crazy attorney’s coming down from raliegh and attacing LEO’s. First Wyrick, now Stansbury….looks like a good civil suit to me…

  • DT patron says:

I was there, don’t know any of them but they were all observably drunk. They had been going back and forth all night. Was anything filed that night by the officer who was hit?

  • Patti says:

I would like to know how this is a major story? Did these two guys know he was an off-duty cop? There are fights every night downtown at some bar and it never makes the news. And many of them start with a sucker punch, so where’s the story? Also, I’d like to know what started the “fight.” The off duty officer was in the face of the one guy, so why or what was the confrontation about? He was off duty, why the special treatment?
Sorry, I admire law enforcement officers, they do a thankless job often, but many I have encountered downtown or at the beach are complete jerks.

  • Kevin Wuzzardo says:

I see what you mean. I’ve removed “taking” from the headline.

  • guesty says:

“WPD officer recovering after taking cheap shot at downtown bar”

The way this story headline sounds, it makes it out that the officer took the cheap shot.
Don’t you think it would sound better: “WPD officer recovering after receiving cheap shot at downtown bar

    Get better soon.

  • Peyton Garrett says:

Boy it takes a bad ass dude to sucker punch like that. These two should remember, What goes around will come around and when You are standing there one night …POW lights out and when it does I hope this cop is there. 90- 120 days in the New Hanover County Jail should calm You two big boys down, Then a nice little Civil Suit to get the attention of your wallet. Losers.

  • justin says:

What a couple of jerks! These two meat-headed rugby players are well known for their on- and off-field shenanigans. I hope the cop and the courts press charges to the fullest extent of the law. Couple of grown men sucker punching a guy – they should be ashamed.
