Man convicted of killing great-aunt granted parole

WILMINGTON, NC (WWAY) — After spending the past 25 years in prison, a man who committed a murder in New Hanover County is being released.

The NC Post Release Supervision & Parole Commission approved parole for Elroy Mitchell, 53, who was convicted in 1994 of killing his grandfather’s sister.

According to online documents, in August of 1992, when family members could not get in touch with Alberta Futch, 81, they went to her home and found her bound body in the bedroom.  Money, a duffle bag, and a shoe box that contained cash were missing from the home.

An autopsy revealed Futch was beaten and strangled.

Mitchell was sentenced to life in prison.

The state’s current sentencing law eliminates parole for crimes committed after October 1, 1994, but Mitchell was sentenced under previous guidelines.

He is scheduled to be released February 28, 2022.
