WILMINGTON, NC (WWAY) — Many lawmakers like House Speaker Nancy Pelosi are calling for President Trump to be removed by invoking the 25th amendment. WWAY wanted to explore what that process would look like and how likely it is to occur.
The 25th amendment was created after the assassination of President John F. Kennedy to clarify the line of succession if the president dies, resigns, becomes sick, or is unable to fulfill his duties.
It has never been used to remove a sitting president.
Vice President Mike Pence and cabinet officials would have to agree the president is not fit to serve. President Trump could then contest that, and then congress would have to vote.
UNCW political science professor Dr. Aaron King says another option is impeachment.
“It seems rather unlikely that either one of these would happen but I wouldn’t rule it out at this point,” King said. “Nancy Pelosi has called on Vice President Pence and the cabinet to go that route, but said that they will consider drafting articles of impeachment as well. So again, very unprecedented time that we are living through right now.”
There are also concerns that the process could not be completed in time before inauguration day.
