NC judge drops case over culinary school’s breaks

RALEIGH, N.C. — A North Carolina judge has dismissed a lawsuit to block $10 million in state subsidies promised to a culinary school.

The Charlotte Observer reported that Wake County Superior Court Judge Michael Morgan ruled Tuesday the breaks offered to Johnson & Wales University in Charlotte served a legitimate public purpose of education and economic development.

Morgan also said taxpayers challenging the breaks used to lure the school lacked standing to sue.

It was the second defeat for the North Carolina Institute for Constitutional Law in the same day. The state Court of Appeals ruled Tuesday that the institute’s challenge of tax breaks to Google Inc. could not proceed because only taxpayers injured by a tax break can sue.
