RALEIGH, NC (NEWS RELEASE) -- Today the North Carolina State Highway Patrol released the results of an internal investigation of Wilmington-based Troopers Edward S. Wyrick Jr. and Andrew M. Smith. The investigation was conducted in response to a complaint and was completed after a thorough, fair and impartial examination of the facts in the case.

The investigation shows that all allegations against Trooper Wyrick were unsubstantiated and he is exonerated. The investigation confirmed that Trooper Wyrick was justified in making the traffic stop and had probable cause for a DWI arrest. No evidence exists that supports the allegations contained within the letter of complaint. Trooper Wyrick will return to full duty status immediately.

The investigation did reveal conduct by Trooper Smith that was unprofessional and in violation of Patrol policy. He is scheduled for a pre-suspension conference next week and will receive additional training on the Patrol Policy violations. At the conclusion of the imposed suspension, Trooper Smith will return to full duty status.

On Monday, June 27, the Highway Patrol received a letter of complaint from Mr. Hoyt Tessener, a Raleigh lawyer, alleging officer misconduct during a traffic stop of his wife that occurred on Tuesday, June 21. Mrs. Gina Tessener was stopped for a broken headlight and then refused to comply with Trooper Wyrick’s requests to conduct roadside tests for intoxication. Mr. Tessener, who followed Trooper Wyrick as he transported Mrs. Tessener to the magistrate’s office, was subsequently pulled over by Trooper Smith for speeding.

Upon receiving Mr. Tessener’s letter, Commander of the Highway Patrol Colonel Michael Gilchrist directed an immediate Internal Affairs investigation into the allegations. Troopers Edward S. Wyrick and Andrew M. Smith were placed on administrative duty pending the investigation’s outcome.

"During the course of the investigation, a number of discrepancies were discovered between what was alleged to have occurred and what we know occurred through witness accounts and other information. The information and evidence obtained during the investigation does not support Mr. Tessener's allegations. However, the investigation did show that Trooper Smith violated Patrol policy, and he will be disciplined accordingly," said Col. Gilchrist.

does their job include projecting an "attitude" like Smith did? Does their job necessitate a "F" him and "F" her view of the driving public? Does their job include an implied threat such as "TELL HIM IF HE WANTS TO COP AN ATTITUDE TO FEEL FREE AND COME BACK AND ILL STROKE HIM THAT SPEED" (upper case as depicted in the Star News). Their job is to write tickets and Smith brought this embarrassment on himself and his agency.

What bothered me most was Gov. Perdue's response that a bad attitude and foul language wasn't grounds for dismissal for Trooper Smith. The NC highway patrol used to be one of the most respected in the country. No more and this is one reason why. It's turned into a "good-ole' boy" organization with no one to keep them in check as one of the other posters pointed out.

SHP's own investigates its own. How come the SBI investigates locals in shooting cases. How fair is an investigation when the investigator is already a member of the same organization? Sounds like more politics to me. The State just authorized this trooper to go out and humiliate others, overdue his authority and not, I repeat not serve the citizens he is supposed to protect. How come you never read any complaints about female SHP Officers? Once again the citizens bear the brunt of over zealous SHP Officers. Not fair, not right and that sorry excuse for a Governor will bear the brunt in votes in 2012!

who would you prefer to investigate? people like you that for unknown reasons have a personal problem with the NCSHP.you have no ideal how the patroloperates and the investgation process in a complaint. There happens to be many complaints that are dealt with by the investigation unit in raleigh manyof which YOU MY FRIEND never hear about which lead to troopers being suspended or fired incluing a FEMALE, i suggest you do your home work more carefully before you turn it in for a final grade,and the next time you are in trouble on N.C. highways think back to your comments when you key in *HP

Humiliation

The only one to humiliate the Tessener duo was Hoyt himself. The SHP never aired their dirty laundry and made a spectacle of them. Hoyt did that by parading his dishonest letter to half of NC government and media. Law enforcement officers do not have to humiliate anyone. Idiots tend to humiliate themselves without any help.

Hmmm...something tells me you don't have a clean track history of your own! If you knew anything about law enforcement agencies, they ALL have their own Internal Affairs division! Yes, all shootings and arsons are investigated by the SBI, all bank robberies, the FBI, etc. But all internal issues are investigated internally. So before you start rattling off your opinion about politics and law enforcement, know the facts!

Agencies do have internal affairs personnel. Unless there has been a policy change, the only statewide jurisdiction the NCSBI has is arson investigations and police shootings, and otherwise has to be invited in by the locals to assist in other felonies. The FBI has federal jurisdiction in bank robberies but can pick and choose which bank robberies to assume that jurisdiction. The FBI can decline a bank robbery if it elects to and let the locals do the investigation.

Next time y'all idiots are at work sending text messages when you should be dropping fries, your supervisor could check your phone messages. This is under heard of. The HP had to dig to find something on Smith. Why is it that you can't deal with fools like Mr and Mrs know it all, not even be around them and text your opinion and be in the wrong. This woman was harrassed and wrongfuly detained for 4 HOURS. She did nothing wrong. "Smelling Alchohol" is probable cause? Next it's, "you look like the drinking type" will be acceptable. Anyone who thinks this stories outcome is good deserves a similar night that Wyrick put her through.

The other trooper pulling her husband over was just coinsidence hunh? Oh and it just HAPPENED to be his little friend he was talking to on the radio, text and I am sure the cell phone. Officers are all out to "get you" not help anymore. If they were truly concerned, money wouldn't be involved. They are glorified meter maids. You know how much labor, money etc they get out of a DUI? Forced Labor for 24+ hours, Fines out the you know what, kickbacks from the insurance agencies after they hike it up, license reinstatement fees, not once but 2x if you are lucky, 3 years on your driving record. So you know how many SHP Troopers were on duty that nite? Can you tell me that? I can tell you how many were... And Im sure it will absolutly shock you... Its actually quite sad. It really doesnt take a rocket scientist to figure out the reason Trp. Wyrick was ONLY in contact with Trp. Smith.

And people bitch about why it takes so long for our Troopers to respond to calls. Maybe you should take that up with our govenor, who YOU voted in, and ask her why we are so short handed and dont have enough Troopers on the roads, and why they (along with most state employees) have not had a pay raise in almost 3yrs. If you ask me, none of our emergency workers (fire, ems, leo) or our teachers are paid enough for the crap they have to put up with and blamed for!

Allegations that were *proven* to be false by facts. By the way, facts are things that can not be disputed because they can be verified. Yes Officers get so much out of a DWI... Low pay and bad hours. Not to mention every aspect of there life under review. What do you think they get a toaster oven as a bonus? I do have knowledge of the system which make me more of an "authority" on the issue does it not? i have had a personal encounter with these officers, have you? Since the officer give his word" to create probable cause based on experience, can i not do the same since i have had the experience? i can tell you this trooper looks like his head will pop in anger at a moments notice. Refuse to do something that is not required of you and he will attempt to intimidate you into doing it. Again how do I know? First hand. You don't know about the matter or the trooper so why commen? An article I read stated that when she was brought into the Wrightsville Beach police station and given a breathalyzer test, she blew a 0. If that is true, then there is most likely trooper harassment going on here. They brought her in because they could, probably not because they truly thought she was DWI.

Yes she blew a 0.00 twice, but how is harassment because she was brought in, he smelled the presence of alcohol and asked her to do a field sobreity test, which she refused so she was taken to jail where she was given the breathalyzer, standard procedure. Her and her husband are mad because they thought they were above the law, Its still funny after watchin the video, the new report thats out and a witness that was in lock up that night how many people are still against this officer, who did nothing wrong!! Glad he will be back on duty!!
