BRUNSWICK COUNTY, NC (WWAY) -- Brunswick County Sheriff's deputies have charged a man for allegedly trying to sell synthetic marijuana and thousands of pieces of drug paraphernalia.

First, after Operation Pipe Dreams S.C. made all forms of smoking paraphernalia illegal, used, intended for use or clean so whatever this guy is doing is illegal in S.C. In fact in Myrtle Beach city limits it is totally illegal and has been that way for over a decade. Secondly, the Justice Department shut down and jailed the owners of the largest one-hitter company in the country, dug-outs because one-hitters are specifically illegal under federal law and so are grinders. This is before we get into the debate over the synthetic pot which when glass pipes or other smoker's articles are sold in conjunction with it are now illegal under State and Federal law. Finally in the recent bust in Idaho a U.S. Attorney Mary J. Olsen clarified that ALL bongs and ANY pipe made from glass is illegal anywhere in the country under the Controlled Substances Act, Google it. I have personally spoken with the D.E.A. and according to them unless a major tobacco company is willing to go on court record and defend a specific type of smoker's article there is no legal defense against federal charges for selling, making, distributing or retailing glass pipes, period. Don't believe it? Call the D.E.A. According to U.S. Customs no law enforcement agency in the country has ever reported glass pipes being found to be used with tobacco and a standard guide in court for interpretation of State laws defining what is or is not paraphernalia is law enforcement testimony about known uses from seizures and I can tell you firsthand that in N.C. no police department has ever witnessed glass pipes or bongs used with anything but marijuana. Fight it all you want you will not win. The U.S. Customs agents I spoke with said anyone shipping or transporting glass bongs or pipes across State lines is in violation of Federal Law, used or not.

Hey Mark, its good to see you are staying active at least. Sorry to see this here. I havent seen you since that party/dinner we had at Miyagi's like 3 years ago. Get in touch when you can, 5 16 48 99. And good luck, this looks like a bum rap. - tongue ring king!

Isn't all of those things legal? I've been in the 4:20 shop in myrtle beach and seen all of those items in the store before. Maybe not in North Carolina but I have def seen those items in a 4:20 shop sounds like trumped up charges to me let the man go!

No, they aren't legal when they are found with an illegal substance. The police know why head shops sell them, but the law only makes them illegal if the police can prove they are intended to be used for an illegal substance.

I've seen the pipes in some places in Myrtle Beach. And they might be considered innocent on the face of the matter, but he was also in possession of drugs, so that absolutely makes it drug paraphernalia.

It isnot only in S.C it is also in N.C.right here in wilmington.Try the smoke shops most have it.Go to Expressions. They wont let u down !
