FIRST ON 3: Brian Berger's home sold at foreclosure auction

WILMINGTON, NC (WWAY) -- New Hanover County Commssioner Brian Berger's home was sold to a bank during a foreclosure auction at the New Hanover County Courthouse Tuesday.

Wells Fargo bought the Wilmington home for $211,917.96.

The home was also owned by Berger's ex-girlfriend Karyn Crichton, but she reportedly moved out of the home several years ago.

Wells Fargo now has a 10-day period to complete the sale. Once that is done, it has 30 to 60 days to serve an eviction notice if it wants.

Berger has not responded to requests for comment.

I work for the Register of deeds and we see countless foreclosure papers everyday. It's public record......So why not report everybody else that has lost a home???? This is not news. This is trying to embarrass a man who already is in the news. I along with my family don't find it entertaining to read about someone else losing a home. It it actually heart breaking that so many people are losing their homes. Find some REAL news to report. We would greatly appreciate it.

It's News!

It's news because Mr. Berger is a county commissioner who makes important decisions for the residents and voters of New Hanover County. Most of those decisions are financial, and residents/voters deserve to know if someone they elected to office is making good, sound financial decisions.

Mr. Berger has already shown, many times over, that he makes extremely poor decisions, financial and otherwise. If he can't handle his own finances, why should he be trusted to make financial decisions for over 100,000 residents of this county?

Receiving news reports such as this one from WWAY keeps residents/voters informed about their elected officials judgements and character, which helps them to determine whether they want to vote that person back into office once again. Obviously, Mr. Berger can't even handle his own checkbook, and his character leaves much to be desired. Bring it on WWAY (and all the news stations)! We, the residents of New Hanover County, need all the information about elected officials that you can give us so that we can make informed decisions when we go to the polls.

he has his faults- but unlike Davis and Catlin hasn't profitted from dealings with government even if legal- and unlike Barfield and THOMPSON HE KEPT HIS WORD. I wont apologize for him- but i do see the corruption and self dealing in wilmington. he made mistakes - catlin and others jumped on him--lets hope feds and sbi look at some of the others who have done far worse than Brian. By the way- where is ben davis with investigation of sandy best? Does wilmington have two standards of justice?

Brian's loan...

has been non-performing for quite some time...and will continue to be until WF either sells the property or rents it. The good news is, WF is now on the hook for the property tax and HOA dues, if his house is in a HOA.

a couple of minor corrections

if it is in an HOA, the foreclosure bank is not on the tab for dues for the remainder of the calander year. And if there was a lien for unpaid dues, that lien is wiped out by the foreclosure.

I am not certain that Congress passed the legislation which would allow a bank to lease reo houses. There had been talk about leasing, prior to foreclosure, a house to the owner for a period of time after the bank acquired title. That would not apply in this case.

And, it may take some months for the bank to gain possession of the property and remove Mr. Berger from occupancy of the property.

the lien wiped out...yes. Monthly dues...no. As the Treasurer of my HOA, I can assure you that in a foreclosure, the dues are immediately the responsibility of the new owner...unless the CC&R's of a HOA address it differently with respect to foreclosures.

What isn't known, at this point, is whether Brian lived in a development controlled by a HOA.

Totally wrong on the HOA dues

Per NC Statute, foreclosure wipes out the HOA dues with respect to the property.

Hate to burst your bubble

but there is a State Statute which over rides any governing document of any HOA or planned community.

One section specifically states the foreclosing lender is not obligated to pay dues for the remainder of the calendar year; and if they sell it during that calendar year, the purchaser is not obligated to pay the dues until the beginning of the next year.

Does not matter what your docs state. Go check out Chapter 47 of the NC General Statutes.

Now an attorney would have charged you $300 for that bit of information.

We all know why your home is taken away from you it's a little thing called payment AKA your mortgage. Failure to pay your mortgage you house is taken away. Since you can't pay for your house maybe you should get a job and go back to school and get a proper education.
