WILMINGTON, NC (STARNEWSONLINE.COM) -- A New Hanover County Superior Court judge on Thursday declared a mistrial in the first-degree murder trial of Davis Ray Belton after the jury failed to reached a unanimous verdict, according to an official at the New Hanover County District Attorney's Office.
Belton, 66, is charged with fatally shooting his wife, Diane Clemmons, in the head while she was lounging in a recliner in the couple's mobile home last year.

Most likely
the DA's office has to decide whether to seek a retrial. There is a time limit, I believe, for that decision to be made.
If they choose not to, he walks.
Another option might be for his attorney to strike some type of deal to avoid retrial.
