BRUNSWICK COUNTY, NC (WWAY) -- Brunswick County District Attorney Jon David says he's ready to move forward with a traffic court program after the North Carolina Supreme Court decided in his favor earlier this month.

The Supreme Court amended an order between Judge Jerry Jolly and David a couple of weeks ago. Hidden in the legal jargon was the go ahead for StreetSafe. David says the Court temporarily lifted Jolly's order to end the driving improvement program. He says this decision stops the order until the Supreme Court hears his case later this year.

David told WWAY he called Judge Jolly's lawyer Thursday out of courtesy to let him know David will move forward in putting the StreetSafe program back into place.

For now, David says he does not have a timetable for when StreetSafe will be back, but he does consider the Supreme Court's decision a win.

David said he has not heard back from Judge Jolly or his attorney.

David says his brief is due back to the Supreme Court by July 15, and then Judge Jolly has 30 days to respond. The District Attorney says he is excited for the Supreme Court to hear the case and feels he has a strong argument, especially after the state legislature voted to make traffic programs like StreetSafe mandatory across the state starting October 1.

David says he believes the Supreme Court will hear oral arguments in September or October.

Judge Jolly issued an order weeks ago stopping the program because he felt David was giving the director of StreetSafe a kick-back for donating less than $250 to his campaign for DA. David's system would allow the DA's office to send young drivers to StreetSafe, where they learn about how dangerous driving can be. It would also take them out of the day-to-day court system, freeing it up, David says, to deal with bigger issues besides traffic violations.

Law enforcement in Brunswick County also agreed with the program because they felt it would allow officers to spend more time on the streets and out of the courtrooms.

Just funny. . where are all the pro-Jolly folks?

Interesting that as this story developed the anti-David, pro Ola/Jolly/Soles folks were saying this was all absurd and that David was out of line. Eating crow must be tough as they evaporated with this story. The law goes into effect statewide on Oct. 1 anyway and the idiocy of Jolly/Ola and their supporters has been exposed.
Vindication is indeed to be savored and the snakes crawl back under the rocks.

District Attorney Ben and Jon David corrupt blogs on facebook

Jon David will never be allowed by the Supreme Court to channel traffic court money exclusively to one company. Not gonna Ever happen. The Supreme Court would never allow that in spite of his skewed premature declaration of victory in a case that has not even been heard or decided. For that I applaud the order entered against him. The corrupt blogs in New Hanover County about Jon David and Ben David detail very troubling ethical actions from both. This news agency should investigate those allegations and report it. Some of these report shady real estate deals of a relative buying real estate from people who have cases prosecuted by them and that he and his brother don't even show their facea at worship service at church any longer.

Impeachment proceedings for illegal searches should be a LAW

Letters to your NC Congressional Courts and Judicial committee members demanding justice through new impeachment laws if you have been a victim of an illegal search or seizure orchestrated by a sitting, campaigning, or former public official in the Courts of North Carolina. Include the dates of the incidents, the name/title of the Judicial Public Official who signed the search warrant or directed law enforcement to obtain it through other judicial employees and for what purpose was the search conducted.

Jon David was right all the time

This new revelation shows that Jon David was right all the time. He previaled and all the gloating from Judge Ola Lewis and Judge Jolly was nothing but a huge bluff. They were acting like attornies and spouting off about the case hoping people would belive them. How did these two highly informed Judges miss the fact that their actions were overturned and try to smoke the public all this item?

These folks need to be turned out of office as soon as possible. They are NOT SERVING the public.

Ola and Jolly lost

When Ola Lewis next tries to insert herself into something she has no authority in, she should think twice. (or think at all). She has made misstep after misstep and her motivations are glaring. Next time she tries to sue someone needlessly or threaten an innocent person doing their job simply because she's a judge, she will be called out. People are watching and learning much about this fraud of an elected official. Shame on Judge Lewis and Judge Jolly. They deserve to be booted out of office and be marginalized for the partisan hacks they are.

Jolly was outta line to begin with

It was all politics from the get go. David came in to clean up the mess Rex Gore made and Jolly was upset his good ole friend was there anymore so he decided to make it difficult for no reason other then to force cops to stay in court longer and likely leading to OT in many cases costing Brunswick and other taxpayers more money (guess this was Jollys way to punish us voters because he didnt like what we did) well thats ok we can deal with him when hes up for re-election and throw him out as well then he can go fishing his his buddies Rex and the pedophile Soles
