BOLIVIA, NC (StarNews) — Opening statements could begin Tuesday in a child molestation case involving a young girl in Brunswick County.

Jay Johnson Waugh Jr., 33, of Sunset Beach is charged with one count of indecent liberties with a minor. Prosecutors dismissed a charge of second-degree sexual offense against Waugh. He was arrested in June 2014 and has since been released on bail.

On Monday, following a motion by the state, Superior Court Judge James Gregory Bell ruled Waugh will be excluded from the courtroom while the victim — who was about 3 when the offense occurred — testifies.  Waugh will be in a nearby room, watching the testimony via closed-circuit television. He will be provided with a cellphone that does not ring, but lights up, with which to maintain contact with his attorney, Assistant District Attorney Jamie Turnage said.
